1. This promotion is open to new and existing Nespresso Members residing in the UK, IoM, CI & ROI, aged 18 or over only. Excludes employees and their immediate families of Nestle S.A. and Nespresso, its agents or anyone professionally connected to the promotion.

2. The reduced price offer is available to qualifying Nespresso Member who purchase any Nespresso Vertuo machine from one of the Nespresso direct channels including calling Nespresso on 0800 442 442 (UK) or 1800 812 660 (ROI), on-line at www.nespresso.com, or a Nespresso Boutique between 09.11.18 and 30.01.19. Offer cannot be claimed via any other retail outlets or via Café NESPRESSO. Any machine purchased after the stated closing date will be at the full price.

3. Nespresso reserves the right at its sole discretion to suspend any user found to be attempting to make more than one valid claim by tampering with the operation of the promotion, setting up multiple accounts, using multiple identities or to be acting in any manner deemed by Nespresso to be in violation of the terms and conditions; or to be acting in any manner deemed by Nespresso to be disruptive. Nespresso also reserves the right to report any activity to the local police if an individual is found to be violating the terms and conditions.

4. How to claim:
By calling Nespresso
- Qualifying Nespresso Members are required to call the Customer Call Centre to place their order with a Coffee Specialist for a Vertuo or VertuoPlus machine during the promotional dates.

- Participants who are not already Nespresso Members will be required to register to qualify for the offer;
- Qualifying Nespresso Members are required add their Vertuo/VertuoPlus machine to their basket.
Via Nespresso Boutique
- Participants must visit their local Nespresso Boutique, register/be registered with Nespresso, and purchase a Vertuo/VertuoPlus machine.

5. At all times during the promotion, Nespresso reserves the right to perform internal checks relating to the Nespresso Member to ensure and protect the integrity of the promotion.

6. Those making claims on behalf of a company or business must be authorised to do so.

7. All Nespresso products are subject to availability.

1. Eligibility

Participants must have purchased one of the following single Nespresso Coffee Machines and registered with Nespresso:
- Nespresso VertuoPlus Red Machine

The specified Nespresso machine must be purchased between 16th November 2018 and 02nd December 2018, directly from Nespresso (our Boutiques, on freephone 0800 442 442, at nespresso.com, or on our app).
The promotion is not available to those who purchase any other Nespresso coffee machine.
N.B. Those purchasing a machine without a Nespresso account (or not setting one up at the same time of purchase) will not be eligible to claim the 120 complimentary Vertuo coffee capsules.
If the qualifying participant goes on to make a further purchase of 100 capsules, or more, in a single transaction before 31.03.19, they will qualify for a second complimentary gift of a Free Travel Mug worth £19 at RRP. Should the participant fail to place a second order of 100 capsules or more before 31.03.19, they will no longer qualify for the gift and the offer will become null and void. No other alternative item or cash will be offered in the event of failure to make the second qualifying purchase within the stated promotional period.

2. How to apply
If one of the eligible Nespresso VertuoPlus Coffee Machines is purchased between between 16th November 2018 and 02nd December 2018, directly from Nespresso (our Boutiques, on freephone 0800 442 442, at nespresso.com or on Nespresso App), you will receive your 120 complimentary Vertuo Coffee Capsules (as per Nespresso Year End Promotion T&c’s).

- Qualifying Nespresso Members are required to call Nespresso to place their order for one of the eligible Nespresso machines with a Coffee Specialist during the stated promotional dates. Participants who are not already Nespresso Members must register to qualify for the offer; - The machine price discount will be applied and the 120 complimentary Vertuo coffee capsules will be sent with their machine order Via www.nespresso.com
- Qualifying Nespresso Members are required add one of the eligible machines to their basket. Participants who are not already Nespresso Members will be required to register to qualify for the offer;
- The machine price discount will be applied automatically and the 120 complimentary Vertuo coffee capsules will be sent with their machine order
Via Nespresso Boutique
- Participants must visit their preferred Nespresso Boutique, register/be registered with Nespresso, and purchase one of the eligible Nespresso machines during the stated promotional dates;
- The machine price discount will be applied and the 120 complimentary Vertuo coffee capsules will be given to the customer

3. Offer Restrictions
- This Promotion cannot be used in conjunction with any other Nespresso promotion, offer or discount except for Nespresso Year End Promotion.
- The Nespresso machine has to be purchased directly from Nespresso (our Boutiques, on freephone 0800 442 442, at nespresso.com or on Nespresso App).
- The Nespresso Machine offer is subject to stock availability.
- You must register with Nespresso (if not registered previously) in order to be entitled to this offer.
- The offer is limited to one Nespresso machine purchase per participant/ Nespresso Member account. If you buy more than one Nespresso machine featured in this promotion, during the stated promotional period. Any additional machines, thereafter, will not qualify for the offer.
- Nespresso reserves the right at its sole discretion to disqualify any individual found to be tampering with the operation of the promotion, setting up multiple accounts, using multiple identities or to be acting in any manner deemed by Nespresso to be in violation of the terms and conditions; or to be acting in any manner deemed by Nespresso to be disruptive.

1. Open to selected Nespresso Members only who have received the special promotional email or direct mail contact inviting them to participate in this promotion. Nespresso Members must be residents of UK or Republic of Ireland, aged 18 or over who are registered with Nespresso. Excludes employees and their immediate families of Nespresso, its agents or anyone professionally connected to the promotion.

2. To qualify for their offer, participating Members must purchase the required number and variety of Nespresso capsules as stated in the promotional message sent directly to them. Such purchases must be made in a single transaction during the stated promotional period.

3. The offer will be valid from 23rd November to 23:59 on 26th November 2018, however, the number of complimentary gifts is limited to a pre-allocated volume. The offer will end at 23:59 on 26.11.18, OR when all allocated stock of the complimentary gifts has been claimed, whichever is sooner. In the event of out of stock of the stated complimentary gift, no cash or other alternative will be available. 3. The Nespresso machine must be purchased between 24th October 2018 and 31st January 2019, from one of the associated Nespresso retail partners, or directly from Nespresso (either from one of our Boutiques, or by calling Nespresso on Freephone UK 0800 442 442, or at www.nespresso.com, or via the Nespresso App). Maximum of one offer per machine purchased per Nespresso Member. Any additional machines purchased during the stated promotional period will not qualify for the offer.

4. How to claim:
Via Customer Call Centre
- Qualifying Nespresso Members are required to call Nespresso to place their order for any Nespresso machine with a Coffee Specialist during the stated promotional dates. Participants who are not already Nespresso Members must register to qualify for the offer;
- The relevant number/type of complimentary coffee capsules will be sent with their machine order.

- Qualifying Nespresso Members are required to add their machine to their basket. Participants who are not already Nespresso Members will be required to register to qualify for the offer;
- The relevant number/type of complimentary coffee capsules will be sent with their machine order.
Via Nespresso Boutique
- Participants must visit their local Nespresso Boutique, register/be registered with Nespresso, and purchase any Nespresso machine during the stated promotional dates;
- The relevant number/type of complimentary coffee capsules will be given by the Coffee Specialist with their machine.
Via another participating retailer
- Customers must visit the promotional website at: www.nespresso.com/UKPromotion, complete an application form with their first name, last name, email address, address and daytime phone number and upload a photo of their qualifying till receipt showing the purchase of any Nespresso machine made between 24.10.18 and 31.01.19. Photos must clearly show the name of the store where the machine was purchased, the date purchased and the itemised machine details. Blurred, out-of-focus or photos where the till receipt is illegible will not be accepted.
All qualifying claims for the free coffee, regardless of route used must be received by no later than 23:59 on 28.02.19, or at the Boutique closing time on that date.

5. If the qualifying participant goes on to make a further purchase of 100 capsules, or more, in a single transaction before 31.03.19, they will qualify for a second complimentary gift of a Free Travel Mug worth £18 at RRP (Original) or £19 at RRP (Vertuo). Should the participant fail to place a second order of 100 capsules or more before 31.03.19, they will no longer qualify for the gift and the offer will become null and void. No other alternative item or cash will be offered in the event of failure to make the second qualifying purchase within the stated promotional period.

6. The free Nespresso items are subject to stock availability and Nespresso reserve the right to supplement this offer with alternative items of equivalent value (RRP £70 across the two gifts). No cash alternative will be available in lieu of the stated items.

These terms and conditions govern your membership to Nespresso & YOU operated by Nestlé Nespresso SA. Please read these terms and conditions carefully.

This version of the Terms and Conditions came into effect in 24th July, 2018.

1. What is Nespresso & YOU Membership? Nestlé Nespresso SA (40 avenue de Rhodanie 1003 Lausanne ("we" or "us") operates a customer recognition programme. Membership is free of charge. There are three levels of membership and your level is determined by the number of year’s continuous membership and the number of capsules purchased during 12 months starting at your first purchase of Nespresso coffee. The Purchase must be made as an identified member directly through a Nespresso channel.

2. How to become a Nespresso & YOU Member? By registering with Nespresso and making your first coffee purchase, you will automatically join Nespresso & YOU. We will ask you to provide us with your contact details, including First Name, Last Name and Email address. Failure to provide the required details, may be deemed as an incomplete registration which may be invalid. Our use of your personal details is governed by our Privacy Notice which you should read carefully. By consenting to these Terms and Conditions and by supplying your personal information to us, you consent to the terms of the Privacy Notice. Your membership starts from the moment you successfully complete your registration, receive a unique Member number and purchase your first coffee. If you are already a Member, your membership shall be considered as started on the date of your first coffee purchase via the qualifying Nespresso channels. You must keep your membership number and password safe and not divulge them to any person. You may not allow others to use your registration details and password to access the Website. You agree to immediately notify us of any unauthorised use of your registration details and password or any other breach of security of which you become aware. To maintain your Nespresso & YOU membership, you must have made at least one valid coffee order in the last 12 months. Corporate bodies, partnerships, trade associations and other commercial bodies are eligible but only one membership is available per person. Joint or family membership is not available. Persons under 18 years of age are excluded. Employees of Nestlé, Nespresso or any associated entities, its agents or anyone else professionally connected with the Nespresso & YOU programme may not eligible to membership benefits.

3. Membership Benefits Connoisseur: Capsule purchase/consumption – Members must purchase up to 1,000 capsules within a 12 month period, and/or have 4 years or LESS continuous membership.* Expert: Capsule purchase/consumption – Members must purchase between 1,000 and 1,500 capsules within a 12 month period, and/or have between 5 and 9 years continuous membership*. Ambassador: Capsule purchase/consumption – Members must purchase more than 1,500 capsules within a 12 month period and/or have more than 10 years of continuous membership*. Level calculation is made by cross-referencing the number of years you have continuously been a member of Nespresso & YOU and the amount of capsules purchased. Capsules purchased are calculated between two Anniversaries. Your first Anniversary refers to your first purchase of coffee through one of the qualifying Nespresso Channels as an identified Member. By Anniversary we mean the month (not the day) of your first coffee purchase from a valid Nespresso channel. Number of years means the number of full 12 month periods with at least one coffee (Original or Vertuo) purchase since your first coffee purchase. Details of your number of years and capsule consumption can be found within “My Member Status” on your membership page at www.nespresso.com. *If you become inactive as a Member (last 12 months without any valid capsule purchases), your number of years as a Member is reset to zero. A valid capsule purchase means:

  • The number of purchased capsules (invoiced capsules within a valid order):
  • Including either Original or Vertuo capsules
  • Cancelled/Returned orders will be deducted from qualifying total consumption numbers
  • Free of charge capsules are not included
  • Only capsules purchased directly from Nespresso UK Ltd can be counted as part of a member’s capsule consumption. Purchases made from retailers or other channels cannot be added and will not be included in a member’s total consumption numbers.

Members should allow at least one full working day (24 hours) from order completion for level changes and/or capsule purchase quantities to be administered and reflected/visible on their account statement; Member benefits are available via Nespresso direct channels only and cannot be redeemed via any other retailer. Your Nespresso & You Membership level can be viewed once you log into the Nespresso website or by speaking to a Coffee Specialist in a Boutique or via our Customer Relationship Centre. All related benefits, rebates and discounts will be shown on your account and will only be visible when logged in. Your Nespresso & You level will be determined solely based on our own records and data and in accordance with the Nespresso & YOU terms and conditions. Nespresso will not change a member’s level status retrospectively based on any other data source.

4. Membership Benefit Nespresso Membership Benefits are offered to you free of charge and we reserve the right to discontinue or change all or part of the Benefits, terms and conditions or the content of the website, at our sole discretion at any time with or without notice. All Benefits are subject to availability.

1. Enjoy free delivery when you buy 100 or more Nespresso capsules.
100 capsules must be purchased in a single transaction with Next Day, Standard or Pick Up Point delivery services. The offer of complimentary delivery cannot be exchanged for cash or product of equivalent value. Not valid in conjunction with any other offer and cannot be claimed via the Café NESPRESSO, Nespresso Boutiques.

2.MACHINE WARRANTY & SERVICE
A 3 year limited warranty including a free Pick Up and Repair of your machine, free replacement spare parts and the use of a free loan machine whilst we repair it. The machine is returned to the pick-up-address and all repairs are covered with a six-month limited warranty. Loan machines are subject to availability and may differ from your existing machine and remain the property of Nespresso UK Ltd. The warranty period begins on the date of purchase and Nespresso requires presentation of the original proof of purchase to ascertain the start date. This limited warranty is subject to specific terms and conditions please see full T&C’s for more information. The terms of this limited warranty do not exclude, restrict or modify, and are in addition to the mandatory statutory rights applicable to the sale of the Product to you. The terms of this warranty do not apply to the exercise of your statutory rights. Other than the statutory rights to which you are entitled at law, all warranties, conditions and other terms not set out in the existing terms of warranty are excluded from this warranty. If any provision or part-provision of this warranty is or becomes invalid, illegal or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted. Any modification to or deletion of a provision or part-provision under this clause shall not affect the validity and enforceability of the rest of this warranty. Should the cost of repairs or replacement not be covered by the terms of this limited warranty, Nespresso will advise the owner and the cost shall be charged to the owner. Limited Warranty Nespresso UK Ltd. (“Nespresso”) warrants your coffee machine (the “Product”) against defects in materials and workmanship for a period of 3 years. The warranty period begins on the date of purchase and Nespresso requires presentation of the original proof of purchase to ascertain the start date. During the warranty period, Nespresso will either repair or replace, at its discretion, any defective Product. Replacement products or repaired parts will be warranted only for the unexpired portion of the original warranty or six months, whichever is greater. If the Product includes a number of accessories, only the defective part or accessory will be replaced. Nespresso reserves the right to make minor adjustments instead of replacing the Product or accessory. Should the cost of repairs or replacement not be covered by this warranty, Nespresso will advise the owner and the cost shall be charged to the owner. This warranty is only valid for active Nespresso customers registered with the UK and/or ROI. To be an active member you must be registered and you must have ordered coffee in the UK and/or ROI in the last 12 months. This limited warranty shall be the full extent of Nespresso’s liability however caused; and Nespresso excludes liability for any loss or damage which is not foreseeable. Loss or damage is foreseeable if it is an obvious consequence of our breach of applicable contractual terms or negligence, or where it could be contemplated by you and us at the time you purchase the Product. Nespresso has no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity. This warranty does not apply to any defect resulting from negligence, accident, misuse, or any other reason beyond Nespresso’s reasonable control, including but not limited to: normal wear and tear, negligence or failure to follow the product instructions (including insufficient aftercare or cleaning), improper or inadequate maintenance, calcium deposits or descaling, connection to improper power supply, unauthorized product modification or repair, use for commercial purposes, fire, lightning, flood or other external causes This warranty will not apply if any serial number has been removed or defaced or if Nespresso receives information from any public or governmental authority that the Product has been stolen. This warranty does not cover the cost of claiming under the warranty or transporting the goods to and from the place of purchase. This warranty is a limited voluntary warranty. The terms of this warranty do not exclude, restrict or modify, and are in addition to, the mandatory statutory rights applicable to the sale of the Product to you. The terms of this warranty do not apply to the exercise of your statutory rights. Other than the statutory rights to which you are entitled at law, all warranties, conditions and other terms not set out in this warranty document are excluded from this warranty. If any provision or part-provision of this warranty is or becomes invalid, illegal or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted. Any modification to or deletion of a provision or part-provision under this clause shall not affect the validity and enforceability of the rest of this warranty. How to Claim Under the Nespresso Warranty If you believe your Product is defective, contact the Nespresso Customer Relationship Centre directly for instructions on how to proceed with a repair. 5. Termination of Membership You may terminate your membership at any time by writing to Nespresso by postal mail (Nestle House, Haxby Road, York, YO91 1XY) by email Ukcrc.General@nespresso.com or by calling the free number 0800 442 442(UK) 1800 81 26 60 (IE). In such an event, we will undertake to remove and securely delete your personal details. Nespresso reserve the right to investigate any unusual activity on any account which they believe may be in breach of these terms and conditions. Any such activity may result in the suspension and possible deletion of an account. We may terminate your membership with immediate effect by giving you written notice if you breach any of these terms and conditions, or abuse the Benefits. We may terminate this programme at any time upon months’ notice to you. We may terminate this programme or any membership immediately in any jurisdiction if required to be applicable local law. We disclaim, to the fullest extent permissible by law, all liability for losses, damages and costs whatsoever, (whether direct, indirect, consequential or otherwise), arising, either directly or indirectly, from your membership, the benefits or the use of any material contained on the website by you, including without limitation any acts or omissions, whether those losses claims or damages result from our negligence or otherwise. We do not exclude our liability to you for: (a) death or personal injury caused by our negligence; or (b) fraudulent misrepresentation by us. If any provision of these Terms and Conditions is or becomes for any reason whatsoever invalid, illegal or unenforceable, it shall be divisible from these Terms and Conditions and shall be deemed to be deleted from them and the validity of the remaining provisions shall not be affected in any way. Nespresso is not responsible for any claims or damages arising from use of any benefits or services provided by a third party.

6. Entire Agreement These Terms and Conditions together with the Privacy Notice constitute the entire agreement between you and us regarding your membership and the Benefits which means that you will not be able to claim that we made any representations or warranties other than contained in these Terms and Conditions. Please note that additional Terms and Conditions of sales apply to the purchase of our products or services.

7. Law and Jurisdiction The present Terms and Conditions shall be governed by and construed in accordance with the laws of England, without effect to its conflict of law provisions. Any dispute or claim arising out of or in connection with this Terms and Conditions (including non- contractual disputes or claims) shall be subject to the jurisdiction of England and Wales.

    Pick Up Orders via Nespresso Boutiques

  3. Pick Up from one of the participating Boutiques may be available for Same Day Pick Up. For Same Day Pick Up, last orders must be placed within a minimum of two (2) hours before the selected boutique closes. Orders will be ready for collection within two (2) hours of confirmation of the order.
  4. Pick Up Service via Boutiques available for Grands Crus coffees only, and is not available for the purchase and pick up of machines, accessories, food bites nor Limited Edition coffees.
  5. Orders can be placed either online, via the mobile app, through the Nespresso Club, or at participating boutiques.
  6. Orders will be ready for collection within two (2) hours of receipt of an order confirmation.
  7. Orders can be collected from the "at your service" desks in the selected boutiques. Club Members will require their email receipts for pick up, or can give their full name and address to allow the Coffee Specialist to check their membership and order status.
  8. Any orders that are not collected within seven (7) days of the date the order is placed, will be refunded via the original payment method, and the goods returned to stock.

  9. Pick Up in the UK via Doddle and CollectPlus UK

  10. The Pick Up Service is available via Doodle and CollectPlus in the UK on orders for all coffees, machines, accessories and food bites.
  11. Orders placed via Doddle or CollectPlus can be made up until 8pm for next day pick up. Next Day Pick Up is available for UK Mainland only. Delivery to the Scottish Highlands Pick Up Point may take between 2-5 days depending on final destination. Club Members can track delivery of their order by using the Order Reference Number which can be found on their Track & Trace email, or on their Shipping Confirmation email, or by logging into their 'My account/My Orders' page of their Nespresso Club account.
  12. Orders should be ready for pick up on the following day from receipt of a confirmed order notification, except in locations such as the Scottish Highlands.
  13. Orders to be picked up at Doodle or CollectPlus UK can be placed via any of the usual channels.
  14. CollectPlus and Doddle orders will be confirmed by email and/or SMS with a bar code. Bar codes will be required for scanning at Doodle or CollectPlus when the item is collected.
  15. Opening hours vary by location. Club Members should check with their local branch before visiting an outlet to pick up their order.
  16. Doddle will hold orders for a maximum of seven (7) days before refunding Nespresso Club Members and returning the goods to the warehouse, if the order is not collected.
  17. CollectPlus will hold orders for a maximum time of ten (10) days before refunding Nespresso Club Members and returning the goods to the warehouse, if the order is not collected.

  18. Pick Up from Parcel Motel, Republic of Ireland

  19. Pick Up Service available from Parcel Motel on orders for all coffees, machines, accessories and food bites.
  20. Orders must be placed by no later than 11:00 am for next day pick up. Orders placed after 11:00 am will be ready for collection within the following 48 hours of confirmation of the order.
  21. Orders to be picked up from Parcel Motel can be placed via any of the usual channels.
  22. Parcel Motel orders will be placed in secure lockers and can be picked up at any time (open 24hrs, 7 days a week, including Bank Holidays).
  23. Parcel Motel will send Nespresso Club Members a notification (email and/or SMS) with the confirmation of delivery, the locker details and secure code to enable them to retrieve their parcel.
  24. Parcel Motel will hold orders for a maximum of seven (7) days before refunding Nespresso Club Members and returning the goods to the warehouse, if the order is not collected.

1.1 These terms and conditions govern your agreement with Nespresso UK Ltd for a Nespresso subscription plan. By choosing to purchase a Nespresso subscription plan you accept these supplementary terms and conditions, in particular the 12 month subscription term (the “Term”). These supplementary terms apply in addition to the General Conditions of Sale, which can be accessed at nespresso.com/uk/en/legal.

How Much is it?

1.2 Your Nespresso subscription plan has a fixed cost which will be charged to you through a Monthly Fee. The Monthly Fee is a fixed fee which varies depending on the subscription plan you select. There is an additional £1 nominal charge for a Nespresso machine.

1.3 The first Monthly Fee, plus £1 for the Nespresso machine will be payable at the time you sign up to the Nespresso subscription plan. The Monthly Fee may be paid by Direct Debit or by debit/credit card. The subsequent Monthly Fees will be payable every month on the same day of the month as when your subscription was activated if you pay your Monthly Fee with a debit/credit card, or on the same day of the month (+ 7 days) if you chose Direct Debit.

Security Checks

1.4 To ensure that your credit, debit or charge card is not being used without your consent, we reserve the right to validate name, address and other personal information supplied by you during the order process against appropriate third party databases. We also reserve the right to perform a credit check. By accepting these supplementary terms and conditions you consent to such checks being made. In performing these checks personal data provided by you may be disclosed to a registered Credit Reference Agency which may keep a record of that information.

What’s Included in the NESPRESSO Subscription Plan?

1.5 In order to purchase a Nespresso subscription plan, you must register as a Nespresso Member. When you purchase a Nespresso subscription plan, you agree to pay the Monthly Fee each month for the Term of 12 months. In return for the Monthly Fee and nominal £1 payment for the Nespresso machine included in your Nespresso subscription plan, you can regularly select Nespresso capsules or other products, which you can choose using your Nespresso Credit as described below, and a Nespresso machine.

1.6 Provided you pass our security and credit checks, the Nespresso machine that goes with your Nespresso subscription plan will be dispatched to you upon receipt of your first Monthly Fee in cleared funds (see section 7 of the General Conditions of Sale). You may not upgrade or change your selected machine during the Term.

1.7 Monthly NESPRESSO Credit:

  • Each month you will receive a fixed amount of Nespresso Credit that you can use to purchase Nespresso coffee or accessories at nespresso.com, by phone, or in our Nespresso Boutiques. The amount of Nespresso Credit you receive is equal to the Monthly Fee for the subscription plan you select – so if your Monthly Fee is £25, you get all of that £25 to spend in the Nespresso or in Nespresso Boutiques.
  • Nespresso Credit will be added to your Nespresso account that is linked to your Membership each month within 4 days of receipt of the Monthly Fee in cleared funds.
  • Make sure that you regularly select what goods you would like to purchase using your Nespresso Credit, as your Nespresso Credit will expire two years after the end of the Term. Any unused Nespresso Credit remaining at the date of expiry will be lost, and you will not receive a refund. You can check your current balance of Nespresso Credit by logging into your account on www.nespresso.com.
  • Nespresso Credit is non-refundable and non-transferable and may not be exchanged for a cash equivalent.

1.8 Cooling Off Period

  • You have the right to change your mind and cancel your Nespresso subscription plan, without giving any reason, within 14 days of the day you receive (or a person nominated by you, if any, receives) the Nespresso machine (the “Cooling Off Period”).
  • To exercise your right to cancel your Nespresso subscription plan, you must inform us of your decision by a clear statement during the Cooling Off Period. You can contact our Customer Relationship Centre on 0800 442 442, or email one@nespresso.com.
  • If you cancel the Contract during the Cooling Off Period, we will repay to you all payments received from you, including delivery charges (except for supplementary costs arising if you chose a type of delivery other than our least expensive standard delivery).
  • We will repay you using the same method of payment as you used to pay us. You will not incur any fees as a result of the repayment.
  • You must send back or hand over to us the Nespresso machine and any capsules that you have received, or that were in transit at the time you notified us that you were exercising your right to cancel. We will make the repayment without undue delay, and in any event no later than 14 days after we have received the Nespresso machine and any capsules back from you, or, if earlier, 14 days after you provide evidence that you have returned them. If you cancel before you have received the Nespresso machine or any capsules, we will repay you within 14 days of the date you inform us that you are cancelling the Nespresso subscription plan. We may withhold repayment until we have received the Nespresso machine and any capsules back from you.
  • You must return the Nespresso machine(s) clean and in good condition, any capsule sleeves unopened, and/or accessories bought with the Credits from your first Monthly Fee. If you do not, we may deduct from the refund the diminished value of the Nespresso machine and capsules.

How Long Does the Subscription Last?

1.9 The Term for a Nespresso subscription plan is 12 months and the Monthly Fee is payable in 12 equal monthly payments. The Term begins on the date on which your first Monthly Fee is received in cleared funds. For information about payments after the Term see After the Term 1.13.

Terminating Your Subscription

1.10 Terminating during the Term: if you wish to terminate your Subscription before the end of the 12 month Term, you may do so by contacting our Customer Relationship Centre on 0800 442 442 or by visiting a Nespresso Boutique or by emailing one@nespresso.com. If you terminate before you have paid all 12 Monthly Fees, you will be required to pay a Termination Fee. The Termination Fee will be the appropriate Termination Fee for your selected Nespresso subscription plan (which is £70 for the £18 Plan, £110 for the £25 Plan, £160 for the £35 Plan, £200 for the £45 Plan). You will not be entitled to a refund for any Monthly Fees already paid at the date of termination.

1.11 This does not affect your statutory right to cancel your order within 14 days from receipt of the Nespresso machine purchased as part of your Nespresso subscription plan, as set out at 1.8 above.

Failed Payments

1.12 If you fail to pay the Monthly Fee when due, Nespresso’s automated system will reattempt again until successful for three consecutive days. Any outstanding balance will be carried forward such that the next payment will be for the previous and current months. Nespresso UK Ltd will freeze access to your Nespresso account after two failed monthly payments until such payment is made. If payment is still outstanding 60 days after the Monthly Fee was due, Nespresso UK Ltd may treat this as your giving notice of termination. You will have to pay the appropriate Termination Fee as set out at 1.10 above if the termination takes effect before the end of the Term.

After the Term

1.13 After the 12 month Term, your Nespresso subscription plan will automatically roll on. Nespresso reserves the right to continue payments of the initial contractual value on a monthly basis until such time as a notification of cancellation (email confirmation sent to one@nespresso.com) is received. The Nespresso machine is yours to keep. Any Nespresso Credit will still be available for you to spend and will not expire until two years after notification of cancellation.

Who Can Subscribe?

1.14 Customers must be at least 18 years old and reside in the UK. There is a limit of one Nespresso subscription plan per person.

Specifically, Nespresso is free to use any ideas, concepts, know-how, or techniques contained in any such communication you send to the Websites for any purpose whatsoever, including, but not limited to, developing, manufacturing, advertising and marketing products using such information. 1. SOURCES OF PERSONAL DATA

This Notice applies to Personal Data that We collect from or about you, through the methods described below (see Section 2), from the following sources:

Nespresso websites. Consumer-directed websites operated by or for Nespresso, including sites that We operate under our own domains/URLs and mini-sites that We run on third party social networks such as Facebook ("Websites").

Nespresso mobile sites/apps. Consumer-directed mobile sites or applications operated by or for Nespresso, such as smartphone apps.

E-mail, text and other electronic messages. Electronic communications between you and Nespresso.

Nespresso CRC. Calls to our Customer Relationship Centers ("CRC").

Nespresso Boutiques. Stores managed by Nespresso.

Offline registration forms. Printed registration and similar forms that We collect via, for example, postal mail, in-store demos, contests and other promotions, or events.

Points of Sales. Demonstrators present in physical third party stores to assist you with the registering of your machine and coffee ordering.

Data from other sources. Third party social networks (e.g. such as Facebook, Google) or market researches (if feedback not provided on an anonymous basis).

2. PERSONAL DATA THAT WE COLLECT ABOUT YOU AND HOW WE COLLECT IT

Depending on how you interact with Nespresso (online, offline, over the phone, etc.), We collect various types of information from you, as described below.

Personal contact information. This includes any information you provide to Us that would allow Us to contact you, such as your name, postal address, e-mail address, social network details, or phone number.

Account login information. Any information that is required to give you access to your specific account profile. Examples include your login ID/email address, screen name, password in unrecoverable form, and/or security question and answer.

Demographic information & interests. Any information that describes your demographic or behavioural characteristics. Examples include your date of birth, age or age range, gender, geographic location (e.g. postcode/zip code), favorite products, hobbies and interests, and household or lifestyle information.

Technical information about computer/mobile deviceAny information about the computer system or other technological device that you use to access one of our Websites or apps, such as the Internet protocol (IP) address used to connect your computer or device to the Internet, operating system type, and web browser type and version. If you access a Nespresso website or app via a mobile device such as a smartphone, the collected information will also include, where permitted, your phone’s unique device ID, advertising ID, geo-location, and other similar mobile device data.

Websites/communication usage information. As you navigate through and interact with our Websites or newsletters, We use automatic data collection technologies to collect certain information about your actions. This includes information such as which links you click on, which pages or content you view and for how long, and other similar information and statistics about your interactions, such as content response times, download errors and length of visits to certain pages. This information is captured using automated technologies such as cookies (browser cookies, flash cookies) and web beacons, and is also collected through the use of third party tracking. You have the right to object to the use of such technologies, for further details please see Section 3.

Market research & consumer feedback. This includes information that you voluntarily share with Us about your experience of using our products and services.

Consumer-generated content. This refers to any content that you create and then share with Us on third party social networks or by uploading it to one of our Websites or apps, including the use of third party social network apps such as Facebook. Examples include photos, videos, personal stories, or other similar media or content. Where permitted, We collect and publish consumer-generated content in connection with a variety of activities, including contests and other promotions, website community features, consumer engagement, and third party social networking.

Third party social network information. This refers to any information that you share publicly on a third party social network or information that is part of your profile on a third party social network (such as Facebook) and that you allow the third party social network to share with Us. Examples include your basic account information (e.g. name, email address, gender, birthday, current city, profile picture, user ID, list of friends, etc.) and any other additional information or activities that you permit the third party social network to share. We receive your third party social network profile information (or parts of it) every time you download or interact with a Nespresso web application on a third party social network such as Facebook, every time you use a social networking feature that is integrated within a Nespresso site (such as Facebook Connect) or every time you interact with Us through a third party social network. To learn more about how your information from a third party social network is obtained by Nespresso, or to opt-out of sharing such social network information, please visit the website of the relevant third party social network.

Payment and Financial information. Any information that We need in order to fulfil an order, or that you use to make a purchase, such as your debit or credit card details (cardholder name, card number, expiration date, etc.) or other forms of payment (if such are made available). In any case, We or our payment processing provider(s) handle payment and financial information in a manner compliant with applicable laws, regulations and security standards such as PCI DSS.

Calls to CRC. Communications with a CRC will be recorded or listened into, in accordance with applicable laws, for local operational needs (e.g. for quality or training purposes). Payment card details are not recorded. Where required by law, you will be informed about such recording at the beginning of your call.

 

3. COOKIES/SIMILAR TECHNOLOGIES, LOG FILES AND WEB BEACONS

Cookies/Similar Technologies. Please see our Cookie Notice to learn how you can manage your cookie settings and for detailed information on the cookies We use and the purposes for which We use them.

Log Files. We collect information in the form of log files that record website activity and gather statistics about your browsing habits. These entries are generated automatically, and help Us to troubleshoot errors, improve performance and maintain the security of our Websites.

Web Beacons. Web beacons (also known as “web bugs”) are small strings of code that deliver a graphic image on a web page or in an email for the purpose of transferring data back to Us. The information collected via web beacons will include information such as IP Address, as well as information about how you respond to an email campaign (e.g. at what time the email was opened, which links you click on in the email, etc.). We will use web beacons on our Websites or include them in e-mails that We send to you. We use web beacon information for a variety of purposes, including but not limited to, site traffic reporting, unique visitor counts, advertising, email auditing and reporting, and personalisation.

Personalisation (offline and online). With your consent (where required), We use your Personal Data (i) to analyse your preferences and habits, (ii) to anticipate your needs based on our analysis of your profile, (iii) to improve and personalise your experience on our Websites and apps; (iv) to ensure that content from our Websites/apps is optimised for you and for your computer or device; (v) to provide you with targeted advertising and content, and (vi) to allow you to participate in interactive features, when you choose to do so. For example, We remember your login ID/email address or screen name so that you can quickly login the next time you visit our site or so that you can easily retrieve the items you previously placed in your shopping cart. Based on this type of information, and with your consent (where required), We also show you specific Nespresso content or promotions that are tailored to your interests. The use of your Personal Data is voluntary, which means that you can oppose the processing of your Personal Data for this purpose. Order fulfillment. We use your Personal Data to process and ship your orders, inform you about the status of your orders, correct addresses and conduct identity verification and other fraud detection activities. This involves the use of certain Personal Data and payment information.

We will also disclose your Personal Data to third parties (i) when required by applicable law; (ii) in response to legal proceedings; (iii) in response to a request from a competent law enforcement agency; (iv) to protect our rights, privacy, safety or property, or the public; or (v) to enforce the terms of any agreement or the terms of our Website.

In addition to the Nespresso/Nestlé entities or ad-hoc in-country partners (in charge of Nespresso operations) mentioned in the data controllers & contact section (see Section 11), We share you Personal Data with the following types of third party organisation:

Service providers. These are external companies that We use to help Us run our business (e.g. order fulfilment, payment processing, fraud detection and identity verification, website operation, market research companies, support services, promotions, website development, data analysis, CRC, etc.). Service providers, and their selected staff, are only allowed to access and use your Personal Data on Our behalf for the specific tasks that they’ve been requested to carry out, based on our instructions, and are required to keep your Personal Data confidential and secure. Where required by applicable law, you can obtain a list of the providers processing your Personal Data (see Section 11 to contact us).

Credit reporting agencies/debt collectors. To the extent permitted by applicable law, credit reporting agencies and debt collectors are external companies that We use to help Us to verify your creditworthiness (in particular for orders with invoice) or to collect outstanding invoices.

Third party companies using Personal Data for their own marketing purposes. Except in situations where you have given your consent, We do not license or sell your Personal Data to third party companies for their own marketing purposes. Their identity will be disclosed at the time your consent is sought.

Third party recipients using Personal Data for legal reasons or due to merger/acquisition. We will disclose your Personal Data to third parties for legal reasons or in the context of an acquisition or a merger (see Section 4 for details).

6. RETENTION OF YOUR PERSONAL DATA

In accordance with applicable laws, We will use your Personal Data for as long as necessary to satisfy the purposes for which your Personal Data was collected (as described in Section 4 above) or to comply with applicable legal requirements.

Personal data used to provide you with a personalized experience (see Section 4 above for details) will be kept for a duration permitted by applicable laws.

7. DISCLOSURE, STORAGE AND/OR TRANSFER OF YOUR PERSONAL DATA

We use a variety of reasonable measures (described below) to keep your Personal Data confidential and secure. Please note, however, that these protections do not apply to information you choose to share in public areas such as third party social networks.

People who can access your Personal Data. Your Personal Data will be processed by our authorised staff or agents, on a need to know basis, depending on the specific purposes for which your Personal Data have been collected (e.g. our staff in charge of customer care matters will have access to your customer record).

Measures taken in operating environments. We store your Personal Data in operating environments that use reasonable security measures to prevent unauthorised access. We follow reasonable standards to protect Personal Data. The transmission of information via the Internet is, unfortunately, not completely secure and although We will do our best to protect your Personal Data, We cannot guarantee the security of the data during transmission through our Websites/apps.

Measures We expect you to takeIt is important that you also play a role in keeping your Personal Data safe and secure. When signing up for an online account, please be sure to choose an account password that would be difficult for others to guess and never reveal your password to anyone else. You are responsible for keeping this password confidential and for any use of your account. If you use a shared or public computer, never choose to have your login ID/email address or password remembered and make sure to log out of your account every time you leave the computer. You should also make use of any privacy settings or controls We provide you in our Website/app.

Transfer of your Personal Data. The storage as well as the processing of your Personal Data as described above require that your Personal Data are ultimately transferred/transmitted to, and/or stored at, a destination outside of your country of residence, notably Switzerland and Luxembourg. We will also transfer your Personal Data to countries outside the European Economic Area (“EEA”) (e.g. other Nespresso/Nestlé entities or ad-hoc in-country partners) including to countries which have different data protection standards to those which apply in the EEA. We (i) have put in place European Commission approved standard contractual clauses to protect your Personal Data (and you have a right to ask Us for a copy of these clauses(by contacting Us as set out below) and/or (ii) will rely on your consent (where permitted by law).

8. ACCESS TO YOUR PERSONAL DATA

Access to Personal Data. Where provided by law, you, your successors, representatives and/or proxies have the right to access, review and request a physical or electronic copy of information held about you. You also have the right to request information on the source of your Personal Data.

If the request is submitted by a person other than you, without providing evidence that the request is legitimately made on your behalf, the request will be rejected.

Please note that any identification information provided to Us will only be processed in accordance with, and to the extent permitted by applicable laws.

Additional rights (e.g. modification, deletion of Personal Data). Where provided by law, you, your successors, representatives and/or proxies can (i) request deletion, the portability, correction or revision of your Personal Data; (ii) oppose the data processing; (iii) limit the use and disclosure of your Personal Data; and (iv) revoke consent to any of our data processing activities.

Please note that, in certain circumstances, We will not be able to delete your Personal Data without also deleting your user account. We may be required to retain some of your Personal Data after you have requested deletion, to satisfy our legal or contractual obligations. We may also be permitted by applicable laws to retain some of your Personal Data to satisfy our business needs.

Where available, our Websites have a dedicated feature through which you can review and edit the Personal Data that you have provided. Please note that We require our registered consumers to verify their identity (e.g. login ID/email address, password) before they can access or make changes to their account information. This helps prevent unauthorised access to your account.

We hope that We can satisfy queries you may have about the way we process your Personal Data. However, if you have unresolved concerns you also have the right to complain to competent data protection authorities.

9. YOUR CHOICES ABOUT HOW WE USE AND DISCLOSE YOUR PERSONAL DATA

We strive to provide you with choices regarding the Personal Data that you provide to Us. The following mechanisms give you the following control over your Personal Data:

Cookies/Similar Technologies. You manage your consent via (i) our consent management solution or (ii) your browser so as to refuse all or some cookies/similar technologies, or to alert you when they are being used. Please see Section 3 above.

Advertising, marketing and promotions. If you wish to have your Personal Data used by Nespresso to promote its products or services, you can indicate so through the relevant tickbox(es) located on the registration form or by answering the question(s) presented by our Trade demonstrators, CRC or boutique representatives. If you decide that you no longer wish to receive such communications, you can subsequently unsubscribe from receiving marketing-related communications at any time, by following the instructions provided in each such communication. To opt-out of marketing communications sent by any medium, including third party social networks, you can opt-out at any time by logging into the Websites/apps or third party social networks and adjusting your user preferences in your account profile by unchecking the relevant boxes or by calling our CRC. Please note that, even if you opt-out from receiving marketing communications, you will still receive administrative communications from Us, such as order or other transaction confirmations, notifications about your account activities (e.g. account confirmations, password changes, etc.), and other important non marketing related announcements.

1. INTRODUCTION

The following are governed by these General Conditions of Sales: all orders placed by individuals, referred to as "you" or "customer", with Nespresso UK Ltd. (registered in England & Wales with company registration number 156925, with registered office at 1 City Place, Gatwick, England, RH6 0PA and VAT registration number GB 169562721), referred to herein as "Nespresso" or "we", "us" or "our", by telephone, on the Website, from your mobile phone via the Nespresso application, on m.nespresso.com (each a "Remote Order") or in a Nespresso Boutique, for machines as well as their consumables and accessories (the "Products").

Before using the Nespresso website and associated webpages (the "Website") and/or placing an order, we kindly ask you to carefully review all the terms included in the present General Conditions of Sales together with the Privacy Policy and the Website Terms of Use and any additional conditions that may appear on the Website from time to time such as during promotions or campaigns.

Each order placed with Nespresso or any of its affiliated companies shall be governed by the present General Conditions of Sales. Unless otherwise provided in the present General Conditions of Sales, they shall apply to the exclusion of all other conditions.

.Our General Conditions of Sales may be modified from time to time by posting a new dated version on this Website. You are invited to read our General Conditions of Sales on a regular basis to be informed of these modifications. You will be subject to the General Conditions of Sales in force at the time you order Products from us, unless any change is required to be made to these by law or governmental authority (in which case it will apply to orders previously placed by you). You may exercise your right to cancel if you are not happy with the changes as they apply to your order.

We will send you a copy of these General Conditions of Sales. You can also download, save and/or print a copy of your order receipt confirmation email and these General Conditions of Sales for your records.

Any order placed through this Website can only be delivered to the United Kingdom of Great Britain and Northern Ireland, the Channel Islands and the Isle of Man. We regret that we cannot deliver elsewhere.

2. ORDERS

2.1 Registration
As a prerequisite to place an order, you will be required to provide mandatory registration information, such as your name or email address that will need to be valid and up-to-date. Please inform us of any changes in your address or other information by updating your personal details on this Website without delay so that we can keep accurate records and deal with your request and orders.

2.2 Password and confidentiality
After the registration procedure is completed on the Website, you will have a unique member account username and password (the "Credentials"). Security and confidentiality are important to us. To prevent your data from being compromised or eavesdropped during the use of our website we enforce the TLS protocol (Transport Layer Security), which establishes a secure and encrypted transmission between your browser and our servers, at all times on our e-Commerce platforms and at least during login on other platforms. We ask you, and it remains your responsibility, to maintain the confidentiality and security of your Credentials. Any successful login using your Credentials, regardless of whether it was executed by you or someone else, will be deemed as a personal act by you.

If you know, or have reason to believe that your Credentials have been stolen or misused, or in case of any other security issue, please notify Nespresso immediately by calling the Customer Relationship Centre on 0800 442 442 (UK Freephone).

You are also invited to take the following precautions:
When you have completed your visit of the Website, always use the Logout button on the top to effectively close the session.

  • Your account username, password and access rights are exclusively for your personal use and should not be transferred to or shared with any other person.

If Nespresso knows or has reason to believe that your Credentials are indeed used by another person, Nespresso shall immediately suspend the use of such account (including processing any transaction from such account).

2.3 Order process

An order of Nespresso Product through the Website is placed by clicking on "Add to Basket" button and proceeding to the checkout page. Minimum and maximum order quantities may also apply, which Nespresso reserves the right to amend from time to time and in its sole discretion.

After placing an order of Product/s on the Website, you will access an order confirmation webpage allowing you to review your order, choose your delivery method and check the total price.

After accepting the General Conditions of Sales, you will be invited to provide payment details to finalise your order.

Please never provide your debit or credit card details on letters or faxes. You will be called back by us to finalise the order and proceed to the payment in a secure way.

2.4 Order confirmation
Once you have submitted and confirmed your order(s), Nespresso will acknowledge receipt of the order(s) by setting out details of the ordered Product(s). This acknowledgement does not confirm our acceptance of your offer to purchase the ordered Product(s).

After confirming receipt of your order(s), Nespresso will check that the relevant Product(s) is (are) in stock. A contract for the sale of Products between you and Nespresso will only be formed when Nespresso confirms that all or part of the Product(s) is/are still available and has/have been dispatched. The contract is formed on sending of the shipment confirmation.

The confirmation of dispatch by Nespresso will be proof of a binding agreement between you and Nespresso. The contract for the sale of Products will relate only to those Products whose dispatch we have confirmed. To the extent permitted by law, Nespresso is entitled to refuse, cancel or terminate an order for any reasonable ground and at any time. For example we may refuse an order if a Product is totally or partially unavailable after the order is made. In this situation, you shall be informed of the delivery of partial order or the cancellation of your order.

If you have already paid for some or all of the Product(s), we will refund you the full amount in respect of the relevant Product(s) and any delivery costs charged as soon as possible. Nespresso may also refuse an order if there is an ongoing dispute concerning payment of prior orders or in the case of abnormal orders and orders which Nespresso suspects are not placed in good faith.

2.5 Prices
The prices payable for the items you order are those displayed on this Website on the date you place your order, inclusive of VAT but exclusive of delivery charges.

Delivery charges, when applicable, will be billed at the rates indicated on the Website on the date you place your order, calculated in accordance with the size of the order and the delivery method you select. You will be advised of the delivery charges applicable to your order during the checkout process and before you place your order.

The price of a Product and delivery costs displayed on the Website and confirmed in your order confirmation will normally be honoured.

Nespresso reserves the right to modify the prices of its Products in the future at any time and without notice. The modifications of prices will not apply to orders of Products already confirmed by Nespresso.

2.6 Payment
Payment shall be made by one of the methods you have selected during the checkout process. Payments can be made by Visa, MasterCard, American Express, Maestro (excl. Maestro on mobile application).

Payments must specify your client number and/or invoice number. Payment by credit or debit card is immediately due and payable at the time you place your order.

Your card details are encrypted during all transmissions for security purposes.

Depending on the payment establishment or payment service provider, payment by credit card may require an authorisation or be executed in multiples steps. In the event Nespresso does not receive the authorisation, Nespresso reserves the right to cancel your order.

No order will be shipped until payment is received or payment has been authorised or processed. The data registered by our payment system constitutes full proof of the financial transactions.

To ensure that your credit, debit or charge card is not being used without your consent, we may validate name, address and other personal information supplied by you during the order process against appropriate third party databases. In performing these checks personal information provided by you may be disclosed to a registered Credit Reference Agency which may keep a record of that information.

3. DELIVERIES

3.1 Delivery
All Remote Orders confirmed by Nespresso will be delivered to the delivery address you specified when placing your order. Nespresso and/or companies authorised by Nespresso may contact you by SMS, telephone and/or email with information regarding your order and delivery. Nespresso does its utmost to ensure standard deliveries (after receipt of cleared funds and subject to stock availability, factors beyond Nespresso's reasonable control and finance validation checks that Nespresso, in its absolute discretion, deems to be necessary) the next day to the UK mainland (for orders placed by 8pm), within 1-2 days to Northern Ireland, and within 5 working days to the Scottish Highlands and Islands, Scilly Isles, Isle of Man, Isle of Wight, and Channel Islands.

In case the delivery has not occurred within the above indicated term, you should either make contact with Nespresso to agree on an additional delay to deliver the Products, or cancel your order by notifying Nespresso. In order to deliver orders on time, Nespresso strives to keep sufficient stocks of Products. However, it is possible that stocks of certain Products turn out to be insufficient for all deliveries to be affected on time. In such cases, you accept that Nespresso is entitled to complete partial deliveries, or to defer delivery.

Orders for Products available in limited quantities (such as Limited Editions, etc.) will only be accepted by us as long as stocks allow.

3.2 Transfer of property and risk
The delivered Nespresso Products shall remain our property until you have paid all amounts owing under the agreement in full, including the payment of all costs included in the order confirmation. All risk of loss or damage to the Products shall be transferred to you upon your taking delivery (or of any persons acting in your place).

3.3 Product verification
At the time of the delivery, you are asked to verify that the number of items being delivered corresponds to that indicated on the delivery confirmation and that the Products are intact, undamaged, not wet and unaltered in any manner. In case you observe damage or missing items, you must notify our Customer Relationship Centre within a reasonable period after you discovered the damage or missing item and not later than two months. Nespresso shall in such case provide you with identical replacement Products. This does not affect your legal warranty statutory rights detailed in Article 4.5 of the General Conditions of Sales.

4. RETURNS AND AFTER SALES

4.1 Cancellations
If you cancel your order before you have received Product(s), you are entitled to refuse the delivery of the Product(s) and we will refund you in full without undue delay and in any event within 14 days after you have notified us of cancelling your order.

4.2 Right of withdrawal
You may decide to cancel your contract at any time from the date of the shipment confirmation up until the date that is 14 days from receipt by you of the Products (or in the case of partial delivery, 14 days from receipt of the last of the Products forming part of the same order) by filling out the withdrawal form that can be found at the foot of these General Conditions, or by calling our Customer Relationship Centre on 0800 442 442 (UK Freephone). In respect of Products purchased from a Nespresso Boutique the foregoing only applies to machines (and not to other Products) and notification of intention to cancel can be made to a member of Nespresso Boutique staff. Once you have notified us of your intention to return the Product/s, you will have 14 days to return the Product/s to us, in accordance with our return policy detailed in Article 4.4 of the present General Conditions of Sales. You are liable for any diminished value of the Products resulting from the handling by you other than what is necessary to establish the nature, characteristics and functioning of the Products.

4.3 Effects of withdrawal
If you exercise your withdrawal right, we shall reimburse to you all payments received from you, including the costs of delivery, without undue delay and in any event not later than 14 days from the day on which we have received the Products back or you have supplied evidence of having sent back the Products, whichever is the earliest. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

4.4 Return Policy
When you return the Product, you must return the Products to us in an undamaged and unused condition at your expense (unless the Product is faulty or not as described) without undue delay and in any event within 14 days from informing us of your intention to return the item. You may be released from returning the Products at your expense by calling our Customer Relationship Centre on 0800 442 442 (UK Freephone) and requesting a free return label. Insofar as possible and practicable, the Products should be returned in their original condition and packaging.

At your expense (unless the Product/s is/are faulty or not as described), you shall send back the Products, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us.

To the extent practicable, and for due process of you request, the Products should be returned accompanied by the invoice and the return form. The deadline is met if you send back the Products before the period of 14 days has expired. Your legal rights regarding defective Products (those that are faulty or mis-described) are not affected by your rights of return and refund in this Article 4 or by anything in these General Conditions of Sales.

4.5 Warranties
Machines purchased are guaranteed by the machine manufacturer pursuant to the warranty conditions listed in the original Product documentation. Please consult your Product documentation for detailed information on the manufacturer's warranty, which is without prejudice to any of your statutory legal rights.

4.6 After-Sales Services
You are responsible for the standard maintenance and cleaning of any machine you purchase from us. Given the technical characteristics of the machines and for safety reasons, repairs must only be performed by the manufacturer's after sales service personnel, in accordance with the conditions specific to each machine. The manufacturer and Nespresso shall be released from any liability resulting from a modification, repair, addition and/or replacement of spare parts on the machine by any person other than the sales service department.

If you encounter any problems or have any questions concerning the functioning, maintenance or after-sales service of your machine, please contact our Customer Relationship Centre on 0800 442 442 (UK Freephone) for advice and assistance. If your requirements are complex, Nespresso may collect your machine at a pre-arranged time, organise the loan of a machine and bring back your machine when repaired at the chosen address.

5. LIABILITY

The photographs and texts illustrating and describing the Products on this Website are non-contractual and for information purposes alone. Nespresso shall not be liable in case of errors or omissions in the photographs or texts displayed on this Website. Without limiting the scope of these General Conditions of Sales and to the extent permitted by applicable law, Nespresso's liability for losses you suffer as a result of our breach of these General Conditions of Sales or our negligence shall be no greater in amount than the purchase price of the Products in respect of which damages are claimed.

Nespresso is only responsible for any loss or damage you suffer which is a foreseeable consequence of our breach of these General Conditions of Sales or our negligence. We are not responsible for any loss or damage which is not foreseeable.

Loss or damage is foreseeable if it is an obvious consequence of our breach or where it could be contemplated by you and us at the time your order is accepted by us Product We expressly exclude any liability for any loss or damage which may be incurred by you as a result of your breach of these General Conditions of Sales. We only supply the Products for personal and private use and you agree not to use the Products for any commercial, business or resale purposes. We have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity.

Nothing in these General Conditions of Sales exclude or limits our liability for: (i) death or personal injury caused by our negligence; (ii) fraud or fraudulent misrepresentation; (iii) defective Products under the Consumer Protection Act 1987; or (iv) for any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.

6. FORCE MAJEURE

Nespresso will make every reasonable effort to fulfil its obligations. However, Nespresso cannot be held responsible or liable for delays or failure to deliver caused by circumstances beyond its reasonable control ("force majeure"). Such circumstances include without limitation strikes and industrial action by third parties, civil commotion, riots, wars, natural catastrophes or any others that make impracticable or impossible the Production, transportation or delivery of Products. In the event of a delay caused by force majeure, Nespresso's obligations will be suspended and the time for performance of our obligations will be extended for the duration of the event. Nespresso will perform its obligations as soon as reasonably possible, and it reserves the right to allocate any remaining Product supply among customers in a fair and reasonable manner. If we cannot perform our obligations due to such an event, you may cancel your contract. To cancel, please contact us. You will have to return (at our cost) any relevant Products you have already received and we will refund the price you have paid, including delivery charges.

7. SEVERABILITY

If any provision or part-provision of these General Conditions of Sale is or becomes invalid, illegal or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted. Any modification to or deletion of a provision or part-provision under this clause shall not affect the validity and enforceability of the rest of these General Conditions of Sale.

8. LAW AND FORUM

The present General Conditions of Sales (and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) and your purchase of Products from Nespresso shall be governed by and construed in accordance with the laws of England. Any dispute or claim arising out of or in connection with General Conditions of Sales or your purchase of Products from Nespresso (including non-contractual disputes or claims) shall be subject to the non-exclusive jurisdiction of the courts of England. If you are a consumer resident in Northern Ireland, you may also bring proceedings in Northern Ireland and if you are a resident in Scotland, you may also bring proceedings in Scotland.

1. Scope & application

1.1 Nestlé Nespresso SA, Avenue de Rhodanie 40, 1007 Lausanne, Switzerland (“Nespresso”) is the promoter and organiser of competitions, games or promotional initiatives (“Promotions”) to which these General Rules shall apply, unless otherwise specified.

1.2 These rules and conditions (“General Rules”) shall apply to any Promotions that are organised by Nespresso on an international basis and that are published or distributed by way of Nespresso's internet website/s at www.nespresso.com or other websites or internet sites, pages or properties generated or managed by Nespresso (collectively “Websites”).

1.3 Each Promotion shall include these General Rules and shall be accompanied by an additional document setting out the specific mechanism and rules applicable to the relevant Promotion (“Specific Rules”). In the event of conflict between the General Rules and the Specific Rules published for a particular Promotion, the Specific Rules shall prevail.

1.4 These General Rules shall not apply to other promotions organised by Nespresso's subsidiary or affiliated entities which shall be subject to applicable local rules and regulations.

2. Participants

2.1 By submitting an entry or participating in a Promotion, participants confirm their understanding and acceptance of these General Rules and any applicable Specific Rules.

2.2 Promotions may not be available in all countries. Nespresso reserves the right to limit a Promotion to participants resident in certain territories or otherwise limit participation, as indicated in the relevant Specific Rules.  Participation shall be automatically void in any territory where a particular Promotion may not be legitimately undertaken.

2.3 Participants may be required to provide proof of eligibility to enter a Promotion or to accept and receive a prize. Unless otherwise specified in the Specific Rules, participants under the age of 18 must obtain and provide on demand written parental or guardian consent to enter or claim a prize.

2.4 In all cases, employees of Nespresso, its Affiliates and their immediate families, as well as their agents or any person professionally connected with a Promotion shall not be entitled to participate.

3. Entries

3.1 Promotions are free to enter and no purchase of any kind is necessary.

3.2 Entries must be submitted in the manner and form and by the closing date and time stated in the Specific Rules. Nespresso may disqualify any entry that is incomplete or does not fully comply with these Rules.

3.3 Only one entry per person is allowed, unless expressly permitted in the Specific Rules. In the event of multiple entries for or on behalf of any person, all entries from that person will be disqualified. Entries from agents, third parties, organised groups or generated automatically by computer will not be accepted.

3.4 No receipt for entries will be issued. Nespresso does not accept responsibility for any entries that are lost, damaged or delayed as a result of postal or other transmission failure or any network, hardware or software failure. Proof of sending will not be accepted as proof of receipt.

3.5 Entries that are vulgar, offensive, indecent, defamatory, inappropriate for general public communication or which portray or encourage illegal activities will be automatically disqualified.

3.6 Participants shall have a general obligation and duty of honesty and fair-play in relation to any Promotion.

3.7 Any breach of the General or Specific Rules will invalidate a participant's entry. If a breach has occurred but is discovered after the award of a prize, Nespresso may require return of the prize. Nespresso may, at its discretion, publish reasons for such breach including the identity of the participant concerned.

4. Prizes

4.1 Prizes are as described in the Specific Rules and, unless specifically stated to the contrary, will not include any other charges, expenses, personal or additional items which will be the sole responsibility of the prize winner.

4.2 A list of winners will be posted on the Website/s. All decisions of Nespresso are final, binding and not open to discussion or appeal. Nespresso will advise winners by e-mail, as provided with their entry, but shall have no responsibility for failed communications or errors however caused.

4.3 The Specific Rules may set a time limit or procedure for claiming or accepting a prize. Failure to claim a prize by the time or in the manner specified will make a potential prize claim invalid and Nespresso may re-offer the prize. 

4.4 If a potential winner cannot be contacted for any reason, or is unable or unwilling to take up a prize, an alternate winner may be selected by Nespresso and offered the prize without any liability to the first potential winner.

4.5 All prizes are non-transferable, may not be re-sold and there are no cash or other alternatives. Prizes are subject to availability and Nespresso reserves the right to substitute prizes of equal or greater value at any time.

4.6 In addition, all travel or holiday prizes are subject to the following:
(a) Nespresso will have full discretion to select appropriate and effective means and times of travel. Travel is subject to availability and must be completed on the dates specified. Restrictions may apply.
(b) It is the responsibility of winners to make arrangements to enable them to take up the prize offered, otherwise a prize may be forfeited and awarded to another participant.
(c) The actual value of travel depends on the date, time, destination and most efficient means of transport. Nespresso will cover actual costs for travel and no cash difference may be demanded or paid in the event of a difference between actual costs and any stated or approximate value.
(d) Winners are responsible for all expenses of a personal or other nature that are not specifically included in the prize description (e.g. spending money, mini-bar, laundry, telephone, pay-per-view, insurance, or other expenses).
(e) Winners are responsible for obtaining and providing all required travel documents, including any required visas, passports, vaccination or health certificates, or other documents required for international travel and/or the prize destination.
(f) Nespresso has no liability if winner/s are unable for any reason to take up a prize as proposed.

5. Personal information

5.1 Nespresso may require Participants to provide personal details as a condition of entry or participation in the Promotion. This includes: full name, postcode and country of residence, e-mail address, telephone (optional), age (or over 18 confirmation). Other information may also be required.

5.2 By participating in a Promotion, Participants undertake that all information submitted is true, current and complete at the time of entry. Participants are solely responsible for the accuracy of personal details and for informing Nespresso of any changes. Nespresso has no responsibility for failed contacts.

5.3 All personal data provided by Participants or received Nespresso will be stored, processed and handled in accordance with Swiss Federal Laws on Data Protection (1992 LPD 235.1 and 1993 OLPD 235.11, as amended) and Nespresso's published Privacy Policy, the latest version of which is available at www.nespresso.com. By accepting these Rules, participants also accept the terms of the Privacy Policy, which they should read before submitting an entry.

5.4 If a Promotion requests or incites Participants, whether for advantage or not, to relay or communicate (“forward”) the Promotion to other persons, or if Participants themselves wish to forward the Promotion to other persons, the following shall apply:

(a) Participants may forward details of or otherwise invite or encourage other persons to participate in the Promotion by email (“Invitation”) either directly or through Nespresso's Website or other technical means  as part of the Promotion, it being understood that Nespresso is simply forwarding the Invitation and has no responsibility for the addressee or content thereof;
(b) In all cases, the Participant is fully responsible for the choice and disclosure of the persons to whom an Invitation is sent and must obtain their explicit consent in advance;
(c) All Invitations shall nominate the Participant as sender and not Nespresso;
(d) Nespresso will not forward more than five Invitations and Participants are required to respect the same limitation.
(e) Email addresses must be valid and different. Participants shall not forward Invitations to persons who have not given consent nor introduce fictitious friends or acquaintances for the purposes of advantage or gain.

5.5 Prize winners agree to take part in any reasonable publicity required by Nespresso and consent to the use by Nespresso or its Affiliates in that connection of their name, likeness and/or images without further compensation.

6. Intellectual property

6.1 All trademarks, brands, logos and other materials or content in relation to Promotions are the exclusive property of Nespresso and may not be downloaded, copied, saved, modified or otherwise distributed or used for any purposes other than as envisaged by the General and Specific Rules.

6.2 All entries submitted and all materials created in connection with an entry shall be the property of Nespresso. If a participant does not agree to any such changes, the sole remedy shall be to withdraw their entry from the Promotion.
