What is Order&Care?
With Order&Care you have your favorite coffee automatically sent to your door. You decide how much and how often you want us to send you your favorite coffee. Without any contract commitment. With every automatic delivery from 10 sleeves of coffee you get at least 1 sleeve for free and we donate 1 € to our coffee farmers.
Do I have to sign a contract?
No. There is no contract commitment or minimum term. You can change, pause or terminate your Order&Care subscription at any time. This works in the Nespresso Boutique, via the Nespresso hotline or via "My Account" on nespresso.com.
My Order&Care
What are the benefits of Order&Care?
As an Order&Care customer, depending on the order quantity, you will receive at least 1 sleeve free with EACH delivery and donate at least 1 € to coffee farmers.
-When ordering from 10 to 19 sleeves, you will receive 1 sleeve for free and we will donate 1 € to coffee farmers.
-When ordering from 20 to 29 sleeves you will receive 2 sleeves for free and we will donate 2 € to coffee farmers.
-When ordering from 30 to 39 sleeves you will receive 3 sleeves for free and we will donate 3 € to coffee farmers.
-When ordering from 40 to 150 sleeves you will receive 4 sleeves for free and we will donate 4 € to coffee farmers.
Can I select the free sleeve?
Yes, we have provided you with a wide selection from different varieties.

You can modify or cancel your Order&Care in the Nespresso Boutique, via the Nespresso Hotline or via "My Account" on nespresso.de.

Is there a quantity limit on the free sleeves I can receive?
Yes. You will receive a maximum of 4 free sleeves per delivery. You will receive 4 free sleeves with each delivery if you order at least 40 sleeves of coffee.

Is there a limit to the amount of donations to farmers?
Yes. We donate a maximum of 4 € per delivery to farmers. We donate 4 € per delivery if you order at least 40 sleeves of coffee.
Will the donation be passed on in full for the farmer?
Yes. We pass on every euro 1:1 to our farmers without deductions.
Which farmers receive the donation?
Currently, 3,491 coffee farmers from Colombia and 1,495 coffee farmers from Indonesia are participating in our AAA Farmer Future program. This program has been in place since 2014 and aims to facilitate the generational transfer of farms from parents to their children and provide a future for young people in coffee-producing regions.

What is a pension fund?
In 2014, Nespresso launched the AAA Farmer Future program. Together with Fairtrade International, the Colombian government and the coffee cooperatives in Caldas, this was the first time a pension plan for coffee farmers was made possible. The program aims to facilitate the generational transfer of farms from parents to their children and provide a future for young people in coffee-producing regions.

For every order&care delivery of 10 sticks or more, we donate an additional €1 to this pension fund.

Are Limited Editions available in Order&Care?
No. Within the scope of your Order&Care order you can only choose from our permanent assortment. However, you can also place a standard order at any time, e.g. with limited editions.
Can I benefit from current offers as part of my order&care?
All Nespresso customers, including Order&Care subscribers, can participate in our promotions. Promotions and offers are just not automatically added to your Order&Care order. To participate in promotions or offers you must place a standard order. This is independent from your Order&Care order.
Are there any activation costs with Order&Care?
No. You only pay for the coffee you order. Also, the delivery costs are always free as part of your Order&Care order.
How do I know when my next order will be delivered?
Simply log in online at nespresso.de with your customer account. Here you will find the next delivery date.

Do I have to pay delivery charges?
No. Each order&Care delivery is free of charge.
How can I pay for the order?
You can pay by invoice, direct debit, credit card and with your credit.
What is the minimum order quantity of an Order&Care?
The minimum order quantity is 5 sleevesof coffee delivered 1 time per quarter.
What are the ordering intervals?
You can choose between the following 4 intervals:
Delivery every 2 weeks, 1 time per month, every 2 months or every 3 months.
Can I take out multiple Order&Care subscriptions?
Yes. You can have multiple Order&Care subscriptions at the same time. To make it clearer for you, you can give each subscription a so-called "nickname". For example: "Sandra's Order&Care".

Geltungsbereich und Vertragspartner

1. Die folgenden allgemeinen Geschäftsbedingungen (im Folgenden „AGB Order&Care“ oder „diese AGB“) gelten für alle Verträge über den Abschluss eines Nespresso Order&Care Abonnements zwischen der Nespresso Deutschland GmbH (im Folgenden „Nespresso") und dem Käufer (im Folgenden „Kunden“). Mit der Bestellung eines Nespresso Order&Care Abonnements akzeptiert der Kunde diese AGBs. Diese AGB gelten ergänzend zu den AGB der Nespresso Deutschland GmbH unter https://www.nespresso.com/de/de/agb.

Wie bestelle ich das Nespresso Order&Care Abonnement und was sind die Vertragsbedingungen?

2. Voraussetzung für den Erwerb und die Nutzung des Nespresso Order&Care Abonnements ist die Anmeldung eines Nespresso Mitgliedskontos.

Es gelten die zum Zeitpunkt des Vertragsschlusses zum jeweiligen Abonnement ausgewiesene Warenpreise laut Nespresso Preisliste.

Sofern während der Abonnementen-Laufzeit eine Erhöhung der Preise eintritt, ist der vom Zeitpunkt der Änderung an gültige Preis zu entrichten. Preiserhöhungen werden von Nespresso vor ihrer Wirksamkeit im Internet auf www.nespresso.de angekündigt.

Die Bestellauswahl (Warenselektion) des vom Kunden gewählten Abonnements kann jederzeit geändert werden. Für die Wirksamkeit der Änderung ist eine Bekanntgabe jeweils mindestens 3 Tage vor dem nächsten Liefertermin erforderlich.

Bei einer Bestellung des Nespresso Order&Care Abonnements auf der Nespresso Website wird Nespresso dem Kunden den Auftrag per E-Mail bestätigen. Bei einer Bestellung per Telefon oder in einer Nespresso Boutique erfolgt die Annahme des Nespresso Order&Care Abonnements ebenfalls durch eine Auftragsbestätigung per E-Mail.

Nespresso ist berechtigt, Bestellungen abzulehnen, Mengenbeschränkungen vorzunehmen oder Kreditlimits festzusetzen, insbesondere im Fall von nicht bezahlten Rechnungen, Kreditrisiken oder Zahlungsunfähigkeit des Kunden.

Zahlungsbedingungen

Der Kunde kann per Bankeinzugsermächtigung, per Rechnung zahlen oder sein Kundenguthaben verrechnen lassen.

3. Der Kunde hat das Recht, innerhalb von 14 Tagen ohne Angabe von Gründen seine Bestellung zu widerrufen. Die Widerrufsfrist beträgt 14 Tage ab dem Tag, an dem der Kunde seine erste Nespresso Order&Care Bestellung getätigt hat. Um die Bestellung zu widerrufen, muss:

eine eindeutige Erklärung (z. B. durch einen mit der Post versandten Brief, per Telefax, Telefon oder E-Mail) zum Widerruf erfolgen. Dafür kann das beigefügte Muster-Widerrufsformular verwendet werden.

Zur Wahrung der Widerrufsfrist reicht es aus, dass eine Mitteilung über die Ausübung des Widerrufsrechts vor Ablauf der Widerrufsfrist abgesendet wird.

Folgen des Widerrufs

Wenn der Vertrag widerrufen wird, werden alle erhaltenen Zahlungen innerhalb von 14 Tagen, ab dem Tag, an dem die Mitteilung über den Widerruf eingegangen ist, zurückgezahlt. Für diese Rückzahlung wird dasselbe Zahlungsmittel, das bei der ursprünglichen Transaktion eingesetzt wurde, verwendet.

4. Das Nespresso Order&Care Abonnement ist unbefristet. Es hat keine Mindestlaufzeit und kann sowohl von Nespresso als auch vom Kunden jederzeit gekündigt werden.

Das Recht zur Kündigung aus wichtigem Grund bleibt hiervon unberührt. Stellt der Kunde seine Zahlungen ein und/oder kommt der Kunde für zwei aufeinanderfolgende Monate mit der Zahlung des Abonnements oder eines nicht unerheblichen Teiles der Vergütung in Zahlungsverzug, so hat Nespresso das Recht das Order&Care Abonnement außerordentlich zu kündigen. Nespresso behält sich vor, ausstehende Forderungen mit dem ungenutzten Guthaben auf dem Nespresso Kundenkonto zu verrechnen.

Unwirksame Klauseln

5. Sollten eine oder mehrere Regelungen dieser AGB unwirksam sein, so zieht dies nicht die Unwirksamkeit der gesamten AGB nach sich. Die unwirksame Regelung wird durch die einschlägige gesetzliche Regelung ersetzt.

Datenschutz

6. Nespresso erhebt im Rahmen der Abwicklung von Verträgen Daten des Kunden und ergreift alle erforderlichen Maßnahmen, um die vom Kunden zur Verfügung gestellten personenbezogenen Daten zu schützen und die geltenden nationalen und europäischen Datenschutzvorschriften jederzeit einzuhalten. Nähere Einzelheiten dazu hält Nespresso unter Datenschutz bereit bzw. übersendet diese dem Kunden auf Anfrage.

Rechtswahl und Gerichtsstand

7. Für diese AGB sowie den Abschluss und die Abwicklung sämtlicher Verträge gilt deutsches Recht.

8. Ist der Kunde Kaufmann, juristische Person des öffentlichen Rechts oder öffentlich-rechtliches Sondervermögen, ist Düsseldorf ausschließlicher Gerichtsstand für alle aus dem Vertragsverhältnis unmittelbar oder mittelbar resultierenden Streitigkeiten. Gleiches gilt, wenn ein Kunde keinen allgemeinen Gerichtsstand im Inland hat, ein Kunde nach Vertragsabschluss seinen Wohnsitz oder gewöhnlichen Aufenthalt in das Ausland verlegt hat oder sein Wohnsitz oder gewöhnlicher Aufenthaltsort zum Zeitpunkt der Klageerhebung unbekannt ist.
