WHAT IS NESPRESSO & YOU?

Nespresso & YOU is a program of Benefits to its consumers of capsules of Nespresso coffee. Participation is free. There are three levels of participation: Connoisseur, Expert and Ambassador. The levels of Members are determined by seniority and number of capsules purchased for 12 (twelve) consecutive months, starting from the first purchase of coffee. Your participation starts from the moment you place your first order for purchase of capsules from the Nespresso domestic line (Original System and/or Vertuo), for through one of our Boutiques, our Customer Service (Telephone 0800 7777 737) or e-Commerce (Site www.nespresso.com/br/pt or App Nespresso for smartphones and tablets). You will not need to re-register just to participate in Nespresso&YOU, you will be automatically affiliated through your first purchase and your consumption of capsules will start counting towards your level. All Nespresso consumers have a unique Membership number. If you are already a Nespresso Member, your participation shall be deemed to have commenced on the date of your first purchase of coffee in the Nespresso. Any person over 18 (eighteen) years old, with a CPF valid in national territory and who makes a purchase of Nespresso capsules from the domestic line (Original and Vertuo) through official channels is eligible to become a Nespresso Member. Legal entities, partnerships, trade associations and other commercial entities are eligible, but only one entry is available per person or entity. Joint or family memberships are not available. People under 18 (eighteen) years old will not be able to participate. Nestlé Group employees are not eligible.

HOW DO I REGISTER TO PARTICIPATE?

Your participation starts from the moment you place your first purchases of capsules from the Nespresso domestic line (Original System and/or Vertuo), for through one of our Boutiques, our Customer Service (Telephone 0800 7777 737) or e-Commerce (Site www.nespresso.com/br/pt or App Nespresso for smartphones and tablets).
You will not need to register again just to participate in the Nespresso&YOU, you will be automatically affiliated through your first purchase and your capsule consumption will begin to count towards your level.

WHAT HAPPENED TO THE NESPRESSO CLUB?

The Nespresso Club was changed in 2019 and changed its name to Nespresso&YOU, the program of Nespresso benefits. When you become a Nespresso&YOU Member, you have a world of exclusive benefits, rewards and events.

WHAT ARE THE PROGRAM LEVELS?

There are three levels of Nespresso Membership for the Nespresso&YOU Program:
• Connoisseur: Members who make at least one capsule purchase in last 12 (twelve) months;
• Expert: Members who have placed at least one capsule order in the last 12 (twelve) months, accumulating a minimum of 400 (four hundred) capsules in the last 12 (twelve) months, OR 4 (four) consecutive years making at least one request for capsules in each period of 12 (twelve) months;
• Ambassador: Members who place at least one capsule order in last 12 (twelve) months, accumulating a minimum of 800 (eight hundred) capsules in the last 12 (twelve) months, OR 8 (eight) consecutive years making at least one order of capsules in each period of 12 (twelve) months
For each level of the program, the consumer accumulates special benefits.

WHAT CRITERIA WERE USED TO DEFINE MY STATUS AT THE START OF THE PROGRAM?

The criteria used to define its status were: seniority or the amount of capsules consumed from Oct/18 to Sep/19. The criterion was chosen offers more benefits to the customer. Seniority means the number of years completed with at least one coffee purchase from the first coffee purchase as a Nespresso customer Your seniority and capsule consumption can be consulted in “My Account” on website, app, at our Nespresso Boutiques or by calling 0800 7777 737. Capsule Consumption means the number of capsules purchased (capsules billed within a valid order) at Nespresso.

WHAT IS THE START DATE OF THE LOYALTY PROGRAM AND FROM WHEN THE BENEFITS ARE VALID?

In Brazil, the program started on 10/09/2019, so all customers who participate in the program must consider this date as the starting date to be entitled benefits, according to the specifics of each status.

WILL THE BENEFITS BE PERMANENT?

At this point, the Nespresso & YOU benefits of each level can be consulted through the website https://www.nespresso.com/br/pt/beneficios. Over time, new benefits may be added, removed or changed without notice. But, always thinking about rewarding you with new experiences.

WHERE DO I FIND MY STATUS?

You can check your status in the “My Account” section, then “My Account Status”. Member” on www.nespresso.com, on the Nespresso app, on one of our Nespresso Boutiques or by contacting our Customer Service at telephone 0800 7777 737. If you cannot view your status, please contact customer service. Nespresso customer on 0800 7777 737 (24 hours, 7 days a week). Employees of the Nestlé group do not participate in the N&Y program.

Will I have a physical card with my status?

With sustainability in mind, cards for the Nespresso&YOU loyalty program will not be issued. Furthermore, as your status can change at any time depending on your capsule consumption, we suggest that you consult the information on your Nespresso App, via 'ACCOUNT > 'MY MEMBER STATUS', or via the website by logging in to your account under 'MY ACCOUNT' > 'MY MEMBER STATUS'. There you will have your Nespresso & YOU status updated.

WHAT DO I NEED TO DO TO LEVEL UP?

Just keep your capsule consumption active and reach the indicated amounts to take it to the next level. Your seniority will also be considered as long as you continue to purchase capsules annually with Nespresso. By consulting your application, you will find all the information you need to evolve your status.

WHY CAN I LOSE MY LEVEL?

As long as you buy Nespresso coffees, you will have access to your status benefits. However, if you don't buy for 12 months in a row, or if you don't buy the minimum amount of capsules during this period, you can go back to your previous status, losing part of your Nespresso & YOU benefits. When you shop with us again, you will enter the level corresponding to your consumption.
If you become inactive as a Member (12 months without any valid capsule purchases), your Seniority level will return to 0 (zero).

CAN MY FAMILY MEMBERS USE MY BENEFITS?

Your family members can enjoy the benefits and offers as long as they use your account (your CPF). Pay attention only to the offers valid 1 time per CPF, which will expire after 1 use per Nespresso account.

Am I entitled to the NESPRESSO BIRTHDAY GIFT?

The Nespresso Birthday Gift is valid for all customers with Ambassador status. The Nespresso Anniversary is the date of your first capsule purchase in our records. It will be a surprise gift and should be automatically added to your next capsule order placed during this period or no later than 11 months thereafter. It is very important that at the time of picking up the gift from one of our Boutiques, website or Nespresso App or by purchasing through our Phone Service, the customer is still in Ambassador status.
By Birthday, we mean the month (not the day) of your first coffee purchase.
(The gift cannot be exchanged or substituted for another item.)

HOW DO I GET THE GIFT SLEEVE AFTER COMPLETING 400 CAPSULES?

For every 400 capsules you accumulate as a Nespresso member, you will receive 1 coffee sleeve as a gift. The capsule count for this benefit is valid from the moment the member becomes an Expert, and will be reset if the customer leaves the program (or if he stops consuming this coffee. The sleeve will be pre-defined by Nespresso.
(Sleeve cannot be exchanged or replaced with another coffee.)

WILL I GET 10% MORE CREDIT ON MY SUBSCRIPTION WHEN ENTERING THE NESPRESSO & YOU PROGRAM?

No, the Nespresso Subscription has been incorporated into the Nespresso & YOU program and the terms and conditions remain the same, with 10% extra credit for all consumers who subscribe to the service, requesting any subscription plan you will enjoy some extra benefits of the N&Y program if you are in Connoisseur or Expert status.

WILL MY STATUS BE RECOGNIZED GLOBALLY?

Benefits and status are only valid in the country where purchases were made. Each market has its own loyalty program and there is no cross-country account connection.

Terms and conditions - Nespresso & YOU

These terms and conditions govern your participation in Nespresso & You, operated by Nestlé Brasil Ltda., a company headquartered at Rua Dr. Rubens Gomes Bueno, 691, São Paulo – SP, registered with the CNPJ under the number 60,490,075/0001-52. Please read these terms and conditions carefully. This version of the Terms and Conditions is effective [October 9, 2019].

1. What does your participation in the Nespresso & You program mean?

Nestlé Brasil Ltda., qualified above, ("we", "Nestlé" or "Nespresso") operates a recognition program for its consumers of Nespresso coffee capsules.

Participation is free. There are three levels of participation and the levels of Members are determined by seniority and the number of capsules purchased during 12 (twelve) consecutive months, starting from the first purchase of coffee. The purchase must be made by an identified Member, through e-Commerce, Boutiques or the Nespresso Customer Service (Telephone 0800 7777 737).

2. How can I be a member?

After placing your first order of capsules from the Nespresso domestic line, through one of our Boutiques, our Customer Service (Telephone 0800 7777 737) or e-Commerce (Site www.nespresso.com/br/en or App Nespresso for smartphones and tablets), you will automatically join. We will ask you to provide us with your contact details.

Any person over 18 (eighteen) years old, with a CPF valid in the national territory and who makes a purchase of Nespresso capsules from the domestic line through official channels is eligible to become a Nespresso Member. Nestlé Group employees are not eligible.

The use of your personal data is governed by our Privacy Policy, which can be found at https://www.nespresso.com/br/pt/termos-condicoes and which you should read carefully. By consenting to these Terms and Conditions and providing us with your personal data, you consent to the terms of the Privacy Policy.

Your participation starts from the moment you place your first order to purchase Nespresso domestic capsules and receive a unique Membership number. If you are already a Nespresso Member, your membership must be considered to have started on the date of your first purchase of coffee on Nespresso.

You must keep your Membership number and password secure and not disclose and/or share them with any third parties. You may not allow others to use your registration data and password to access our Site or Application. You agree to notify us immediately of any unauthorized use of your registration data and/or password or of any other breach of security of which you become aware.

To become a Nespresso Member, you must have at least one valid coffee purchase during the last 12 months. Legal entities, partnerships, trade associations and other commercial entities are eligible, but only one participation is available per person or entity. Joint or family memberships are not available. Persons under the age of 18 (eighteen) will not be able to participate.

3. Member types:

Member types:

  • Connoisseur: Members who make at least one capsule purchase in the last 12 (twelve) months;
  • Expert: Members who place at least one order of capsules in the last 12 (twelve) months, accumulating a minimum of 400 (four hundred) capsules in the last 12 (twelve) months, OR 4 (four) consecutive years placing at least one order of capsules in each period of 12 (twelve) months;
  • Ambassador: Members who place at least one capsule order in the last 12 (twelve) months, accumulating a minimum of 800 (eight hundred) capsules in the last 12 (twelve) months, OR 8 (eight) consecutive years placing at least one order of capsules in each period of 12 (twelve) months.

The level calculation is done by crossing the Member's seniority level with the amount of capsule consumption. Capsule consumption is calculated between 2 (two) Anniversaries with Nespresso. Your first Anniversary refers to your first purchase of coffee through one of the Nespresso channels, as an identified Member.

By Birthday, we mean the month (not the day) of your first coffee purchase.

Seniority means the number of years completed with at least one coffee purchase since the first coffee purchase.

Your seniority and capsule consumption can be consulted in “My Account” on the website, app, in our Nespresso Boutiques or by calling 0800 7777 737.

If you become inactive as a Member (12 months with no valid capsule purchases), your membership level Seniority will return to 0 (zero).

Capsule Consumption means the number of capsules purchased (capsules billed within a valid order):

  • It only includes capsules from the domestic line purchased from the following official Nespresso channels: website www.nespresso.com/br/en, app, phone 0800 7777 737 or Nespresso Boutiques;
  • Orders canceled or returned will be deducted from Capsule Consumption. For example, if a Member purchases twenty (20) capsules and voluntarily cancels the order before receipt, these twenty (20) capsules will be deducted from their Capsule Consumption.
  • In the event that the purchase of capsules is made without identification or if the Nespresso & You program system is unavailable through official Nespresso sales channels, this specific purchase will not be counted towards Participation purposes.
  • Purchase date refers to the capsule order billing date.
4. Benefits of your participation

The Benefits for Participation in the Nespresso & You program are offered free of charge and we reserve the right to discontinue or modify, in whole or in part, the Benefits or the website content as we see fit at any time or without notice.

All Benefits are subject to availability and are valid only in national territory. Nespresso will not accept exchanges or returns of discounted items as part of the Nespresso & You benefits.

To see your Benefits in the Nespresso & YOU program, access the website www.nespresso.com/br/en, the app, telephone 0800 7777 737 or visit one of the Nespresso Boutiques.

4.1 Benefits description:

a) FREE SHIPPING: free shipping for domestic line capsule orders placed through the website, app or phone, in the official Nespresso channels, in compliance with the Privacy Policy and Conditions of Sale;

b) COFFEE EXPERIENCES: access to classes provided by Nespresso in its boutiques and/or other official channels and/or Nespresso social networks (https://www.nespresso.com/br/pt/eventos);

c) COFFEE TASTING: coffee tasting at Nespresso boutiques, upon proof of Membership status, in the app or for Nespresso boutique attendants;

d) SUBSCRIPTION WITH EXTRA CREDIT: Nespresso coffee subscriptions were incorporated into the benefits program, it is the same service: 10% extra credit on the value of the plan chosen by the customer. For more information, visit: https://www.nespresso.com/br/pt/assinatura.

e) STATUS UPGRADE BONUS: when you upgrade to Expert or Ambassador status, you get a 10% discount on the purchase of 100 coffees, for the next 30 days after the level change.

f) EXCLUSIVE SALES: access to selected products and exclusive offers, the availability and frequency of which will be determined by Nespresso;

g) NESPRESSO PARTNERSHIPS: access to selected benefits with Nespresso partners nationwide. Partnerships will be announced in due course by Nespresso to eligible customers.

h) CUSTOMIZED OFFERS: get access to exclusive offers on your favorite coffees and accessories.

i) MACHINE DISCOUNT: once a year you can enjoy a 25%* discount on the purchase of a Vertuo System machine or a 10% discount on the purchase of an Original System machine. *Offer valid from 02/06/2022.

j) TAKE CARE AND ASSISTANCE: our completely free machine technical assistance service, regardless of the warranty period for your Nespresso.

k) NESPRESSO ANNIVERSARY: the Member will receive a gift, to be defined by Nespresso, upon placing an order of coffee in his/her Anniversary month as a Member (information provided in the registration of each member) or in any of the following 11 months;

l) ACCESS IN EVENTS: access to events with limited seats, upon registration on the official Nespresso events platform (https://www.nespresso.com/br/pt/eventos);

5. End of your participation

You may terminate your Participation in the Nespresso & You program at any time by contacting Nespresso via the website https://www.nespresso.com/br/en/fale-conosco, app, telephone 0800 7777 737 or Nespresso Boutiques. If you wish, Nespresso may erase your personal data or just temporarily deactivate your account.

We may terminate your Membership with written notice if you fail to comply with any of these terms and conditions or abuse the Benefits.

We may modify or terminate this program at any time by giving you three (3) months notice. We may change or terminate this program or any Participation immediately, as required by local law. We may change the Benefits or these terms and conditions at any time without notice.

We will not be liable, to the extent permitted by law, for any losses, damages and costs of any nature (direct, indirect or otherwise) arising, directly or indirectly, from your Participation, the Benefits or the use of any material contained on the website. by you, including, without limitation, any acts or omissions.

We will not be exempt from our responsibility in case:

(a) death or personal injury caused by our negligence; or
(b) erroneously fraudulent interpretation by us.

If any provisions of these Terms and Conditions are or for any reason become invalid, illegal or unenforceable, they shall be removed from these Terms and Conditions and deemed to have been deleted from them and the validity of the remaining provisions shall not be affected in any way.

Nespresso will not be responsible for any claims arising from the use of Benefits or services provided by third parties.

This term is based on all other terms and conditions already in force by Nespresso Brasil Ltda.

6. Full content

These Terms and Conditions, as well as the Privacy Policy, constitute the entire content of the agreement between you and us regarding your Participation and the Benefits, which means that you may not require us to make any promises or guarantees other than those contained herein. in these Terms and Conditions.

Please note that additional sales terms and conditions apply to purchases of our products or services.

7. Law and Jurisdiction:

These Terms and Conditions shall be governed by the laws of the Federative Republic of Brazil.

Any disputes or demands arising out of or in connection with these Terms and Conditions (including noncontractual demands) will be subject to the Central Forum of the district of São Paulo - SP.
