U.S. State Privacy Notice

California, Colorado, Connecticut, Utah, and Virginia have enacted consumer privacy laws that grant their residents certain rights and require additional disclosures. This U.S. State Privacy Notice ("Notice") addresses these state-specific requirements and also serves as our California notice at collection.

If you are a resident of one of the states listed above, this Notice, together with our Privacy Policy, applies to you.

We may update this Notice from time to time. If we make changes, we will notify you by revising the Last Updated date above. If we make material changes, we will provide you with additional notice (such as by adding a statement to our websites and mobile apps or sending you a notification). We encourage you to review this Notice regularly to stay informed about our information practices and the choices available to you.

Collection, Use, and Disclosure of Personal Information

As described in our Privacy Policy, we collect, use, and disclose personal information about you. Below, we use two different tables to explain this same information in accordance with state privacy laws. The tables describe our data practices now and over the past 12 months.

Personal Information that we “Share,” “Sell,” or Use for “Targeted Advertising”

We disclose the following categories of personal information to third parties for the purpose of engaging in targeted advertising and other marketing activities, including to expand the reach and effectiveness of our own marketing campaigns and for the third parties’ own marketing purposes. While we do not disclose your personal information for money, these activities are considered “sales,” “sharing,” or “targeted advertising” under certain state laws and you have the right to opt out of having your personal information used or disclosed for these purposes. See below for details about opting out.

Other Details About Our Information Practices

- As described in more detail in our Privacy Policy, we collect personal information from different sources, including: directly from you, automatically when you access or use our Services, and from third-party sources (such as our business partners and affiliates).
- We do not knowingly collect, sell, or share personal information about consumers under the age of 16.
- We do not use or disclose sensitive personal information for the purpose of inferring characteristics about you.
- We retain personal information for as long as necessary to carry out the purposes for which we originally collected it and for other purposes described in this Notice and our Privacy Policy.

Additional Privacy Rights

Opting Out of Sales, Sharing, and Targeted Advertising. As described above, you have the right to opt out of having your personal information sold, shared, or used for targeted advertising. You may opt out by clicking the “Your Privacy Choices California Consumer Privacy Act (CCPA) Opt-Out Icon” link found in the footer of our website and following the instructions in the pop-up window. If you are on a Nespresso app, you can opt out by visiting Your Privacy Choices in My Account. You can also opt out by visiting our Services with a legally recognized opt-out preference signal enabled, such as the Global Privacy Control. Please note that you will need to renew your opt-out choice if you visit our Services from another device or browser or if you clear your cookies because your opt-out choice will be linked to your browser only.

Access, Correction, and Deletion. You have the right to (1) request to know more about and access your personal information, including in a portable format, (2) request deletion of your personal information, and (3) request correction of inaccurate personal information. To request access, correction, or deletion of your personal information, you may submit this webform or contact Customer Service at 1-800-562-1465. We may verify your request by asking you to provide information related to your recent interactions with us, such as your name, email address, or phone number. Please note that you can also access, correct, or delete certain information stored within your online account at any time by logging into your online account.

Nondiscrimination. We will not discriminate against you for exercising your privacy rights.

Authorized Agents. You can designate an authorized agent to submit a privacy rights request on your behalf. We may ask authorized agents to submit proof of their authority to make a request, such as a valid power of attorney or proof that they have signed permission from the consumer who is the subject of the request. In some cases, we may be required to contact the consumer to verify his or her identity or confirm the authorized agent has permission to submit the request. Authorized agents seeking to make a request to access, correct, or delete personal information can either submit this webform or contact Customer Service at 1-800-562-1465. Please do not provide any sensitive personal information in connection with the request, such as a driver's license or other government-issued ID.

Appeals. In some cases, we may deny your privacy rights request. You have the right to appeal our decision by contacting us at USDataProtection@Nespresso.com. If you have concerns about the result of an appeal, you may contact the attorney general in the state where you reside.

Notice of Financial Incentives

We provide discounts, rewards, exclusive offers and other benefits to customers, such as when they register for an account, participate in our promotional campaigns, or sign up for our marketing emails or text messages. These offerings may constitute “financial incentives” or “bona fide loyalty programs” under certain state privacy laws (for simplicity, we refer to these offerings as “financial incentives” throughout this Notice).

If you decide to participate in a financial incentive, we collect relevant personal information from you, such as identifiers (like your email address and phone number), commercial information (like your purchase history), and inferences (including about your favorite products and preferences). We disclose this information to our service providers that perform services on our behalf, including payment processing, product fulfillment, marketing, database management, analytics, and customer service.

You can opt into a financial incentive by creating an account, signing up to receive our marketing communications, or otherwise following the instructions we provide to participate. You have the ability to opt out of financial incentives at any time. To opt out of receiving text messages, please send a reply text that says “STOP.” To opt out of promotional emails, please follow the unsubscribe instructions in those communications. To opt out of other financial incentives, you can contact us at USDataProtection@Nespresso.com or use this webform to request we delete your personal data. Please note that if you request that we delete personal data that is essential to providing you with the financial incentive, we will not be able to provide you with such benefits going forward. For example, if you ask us to delete your email address, we will no longer be able to email you discounts or other exclusive offers or benefits. In some cases, we may provide additional terms and conditions when you sign up to participate in a financial incentive. The value of your personal data is reasonably related to the value of the offer or discount presented to you.
