利用規約
1. 利用規約の容認と改定
1.1 関連会社を含むネスレネスプレッソS.A.(以下「ネスプレッソ」)のウェブサイト(以下「ウェブサイト」)へのお客様のアクセス、ならびにその利用は、本利用規約(以下「利用規約」)によって規定されます。当社のウェブサイトにアクセスし、それをブラウズ、利用した時点で、お客様はこれらの利用規約を読み、理解し、無条件で受け入れることを認めたものとします。
1.2 当社は、以下のいずれかの場合、お客様の事前承諾を得ることなく、利用規約を適宜改定できるものとします。
- その改定がお客様の利益に適合するとき。
- その改定が、当社ウェブサイトの目的に反せず、かつ、改定の必要性、改定後の内容の相当性、その他の改定に係る事情に照らして合理的なものであるとき。
1.3 当社は、利用規約の改定にあたり、改定後の利用規約の効力発生日の7日前までに、利用規約を改定する旨及び改定後の利用規約の内容とその効力発生日を当社ウェブサイト上に掲示し、またはお客様にEメールで通知します。
1.4 お客様が改定後の利用規約の効力発生日以降に当社ウェブサイトを利用した場合、利用規約の改定に同意したものとみなします。
2. 著作権と知的財産権
2.1 テキスト、マーク、ロゴ、図表、写真、ビデオ、サウンド、音楽、レイアウト、デザイン、ノウハウ、テクノロジー、製品、プロセスといった当社ウェブサイトのコンテンツは、いずれもネスプレッソないしはその関連会社の所有物であるか、あるいは所有者の認可を得て用いられており、該当する法の下に存在する著作権、商標、特許その他の知的財産権、産業財産権によって保護されています。
2.2 後述の第3項で触れられている場合を除き、当社ウェブサイト内に、これらのコンテンツを使用する権利や許諾をお客様に与えると解釈ないしは理解されるべき箇所はいっさいありません。
3. ウェブサイトの利用
3.1 まったくの非商業的な個人使用目的に限り、お客様は当社ウェブサイトのコンテンツをダウンロード、ディスプレイ、プリントすることができますが、その場合もダウンロードする情報等の素材に含まれる著作権表示やその他の財産権表示はいっさい削除せず、そのまま再現してください。全体、あるいは一部を問わず、ウェブサイトのコンテンツの複製、修正、配給、送信、放送など含むそれ以外の利用法は、いかなる手段であれ、厳密に禁じられています。ただし事前にネスプレッソから書面で認可を得ている場合は、この限りでありません。
3.2 お客様が当社ウェブサイトに表示されているコンテンツを利用された場合、それが第三者の権利を侵すものではないことを、ネスプレッソでは明言いたしかねます。またその保証もいたしません。
4. 機密性はないとみなされる情報
4.1 お客様がインターネット経由で当社ウェブサイトに送信される個人特定データならびに情報は、すべて当社のプライバシーポリシーに沿って保護され、取り扱われています。そうした個人特定データならびに情報を提供する前に、このプライバシーポリシーを熟読されることをお勧めします。
4.2 Eメールほかの手段によって、インターネット経由でネスプレッソに伝達される、それ以外の情報ならびに素材(データ、質問、コメント、提案、アイデア、グラフィックス等を含む)はすべて、非機密扱いを受けます。お客様からの送信やポスティングは、すべてネスプレッソの所有に帰し、複製、開示、送信、出版、放送、ポスティングなど、あらゆる目的で自由に使用できるものとします。特にお客様がウェブサイトに送られた情報に含まれるアイデア、コンセプト、ノウハウ、テクニックはすべて、開発、製造、広告、それらの情報を用いたマーケティングなど、あらゆる目的で自由に使用できるものとします。その使用に際しては、情報の提供者、あるいはほかのいかなる人物にも、報酬はいっさい支払われません。
4.3 情報を送信した時点で、お客様は送信した素材/コンテンツが自分の所有物であること、中傷的な内容ではないこと、そしてネスプレッソが使用しても、第三者の権利を侵す危険はないことを保証したものとします。またネスプレッソには、提供された情報を使用する義務はありません。
5. 保証の放棄
5.1 後述の第6項に影響を与えることなく、お客様がウェブサイトで目にされる素材、情報等はすべて、「現状有姿」で提供されています。また明示あるいは黙示を問わず、いかなる種類の保証も行うものではなく、とりわけ商品性や特定目的への適合性を黙示的に保証するものではありません。
5.2 ネスプレッソは当社のウェブサイトやそのコンテンツが、つねにお客様の期待に応え、決して中断せず、タイムリーで、安定し、エラーとは無縁であることを保証しません。
5.3 司法管轄が異なる地域では、保証の限定が許されない場合もあるため、一部のお客様には、上記の排他条件が適用されない可能性もあります。
5.4 口頭であれ書面であれ、ネスプレッソから得られた、あるいはサービスの利用中にサイトで入手されたアドバイスや情報はすべて、現状の利用規約で明示されていない保証をいっさい生じさせません。
6. 責任の限度
6.1 当社ウェブサイトへのアクセスや、その利用、ブラウズ、ナビゲートはお客様が自己責任で行うものとします。
6.2 お客様はウェブサイトの作成、制作、供給に関わったネスプレッソとその関連会社、あるいはその他の関係者が、お客様がウェブサイトないしはそのコンテンツにアクセスし、利用することによって、あるいは逆にそれらを利用できなかったことによって生じる可能性のある直接的、間接的、付随的な損害、名誉毀損、経費、損失、利益の減少ないしはあらゆる性質の不利益に対し(たとえそうした損害の発生をネスプレッソがすでに知っていた、あるいは知りうる立場にあったとしても)、該当の規則が認める限りにおいて、責任を問われないことを認め、受け入れたものとします。
6.3 当社ウェブサイトの利用中に、それ以外の経路からダウンロードされたり、取得されたりした素材については、すべてお客様が自己責任で対応するものとします。当社ウェブサイトの素材へのアクセス、ないしはその使用やダウンロードが理由で、お客様のコンピュータやその他の所有物にダメージが生じる、ウィルスに感染する、ITシステムへの違法な侵入や介入が起きるといった事態が生じても、ネスプレッソではいっさい責任を負いません。
6.4 ネスプレッソは当社ウェブサイトの機能の一部ないしはすべてを中断、中止する権利を保有します。ネスプレッソないしは第三者の作為や不作為によって、当社ウェブサイトの機能を一部ないしはすべて中断、中止するような事態が生じても、ネスプレッソではいっさい責任を負いません。
7. 情報の変更
当社ウェブサイトのコンテンツには、不正確な箇所やエラーが含まれている場合もあります。ネスプレッソは事前の告知抜きで、そうしたコンテンツに変更、訂正、改善、ないしはそのすべてを加える権利を保有します。ただしそうした作業を行う責任はいっさい負いません。
8. 製品/サービスの入手度
当社ウェブサイトには、全世界的なネスプレッソの製品やサービスが掲載されている場合もあり、そのすべてがあらゆる地域で利用できるとは限りません。ウェブサイトで触れられている製品やサービスであっても、お客様がお住まいの地域では利用できない場合もあります。
9. リンク
9.1訪問されたお客様へのサービスとして、当社のウェブサイトが、ネスプレッソの管理外にある外部のウェブサイトにリンクしている場合があります。これらのサイトについて、ネスプレッソは責任を問われるものではなく、そのコンテンツ、合法性、正確さ、機能についても、いっさい責任を負いません。
9.2 当社ウェブサイトへのリンクについては、かならず事前にネスプレッソから書面の認可を得てください。
10. その他
10.1 本利用規約は、ウェブサイトとそのコンテンツへのアクセスとその利用に関し、ネスプレッソとお客様のあいだで結ばれた合意を統合したものです。ネスプレッソが提示するお客様との関係、とりわけサービスや製品の購入にまつわる関係を規定したその他の規約や条件はすべて、利用規約を補完するものとなります。そのあいだになんらかの齟齬が生じた場合には、その他の規約や条件が本利用規約に優先します。
10.2 利用規約に記された義務の履行をお客様が怠った場合、かりにネスプレッソがその事実を看過し、それによって生じる、ないしは法の下で認められた権利を施行しなかったとしても、当社がその権利を行使し、施行することを放棄したものと解することはできません。
10.3 現行ないしは将来的な法律や規定、あるいは法廷の裁定によって、利用規約の条項のいずれかが非合法と見なされた場合でも、それ以外の条項は、お客様とネスプレッソのあいだですべての効力を保持するものとします。
10.4 利用規約の条項の表題はあくまでも利便性を目的としており、いかなるかたちでも規約や条件の内容に影響するものではありません。

販売条件
1. 一般販売条件の適用
1.1 Nestlé Nespresso S.A.又はその関連会社(「ネスプレッソ」)へのインターネットによる注文は最新の一般販売条件に準拠します。その他すべての条件を排除して一般販売条件が適用されます。注文をすることにより、お客様は最新の一般販売条件を読み、理解し無条件に承諾したことを認めたものとします。
1.2 本ウェブサイトを使用することにより、お客様はまたネスプレッソの利用条件及びプライバシーポリシーに拘束されることを承認及び同意したものとします。本ウェブサイトにて提供されるサービスを利用する前に、これらをよくお読みください。
1.3 ネスプレッソは、以下のいずれかの場合、お客様の事前承諾を得ることなく、一般販売条件を適宜改定できるものとします。
- その改定がお客様の利益に適合するとき。
- その改定が、本ウェブサイトの目的に反せず、かつ、改定の必要性、改定後の内容の相当性、その他の改定に係る事情に照らして合理的なものであるとき。
1.4 当社は、一般販売条件の改定にあたり、改定後の販売条件の効力発生日の7日前までに、販売条件を改定する旨及び改定後の販売条件の内容とその効力発生日を本ウェブサイト上に掲示し、またはお客様にEメールで通知します。
1.5 お客様が改定後の販売条件の効力発生日以降に本ウェブサイトを利用した場合、販売条件の改定に同意したものとみなします。
1.6 ネスプレッソでは、品質管理その他の観点から、最終消費者の皆様に直接カプセルコーヒーを販売することを旨としており、あらかじめ合意している場合を除き、再販売を目的とする方へのカプセルコーヒーの販売は行っておりません。
2. 登録
2.1 本ウェブサイトでメンバー登録する際、お客様は提供する登録必須情報が正確かつ完全であることを確認しなければなりません。
2.2住所の変更、その他の変更がある場合は遅延なく本ウェブサイト上の個人情報の詳細を更新してネスプレッソに通知してください。
3. パスワード
3.1 本ウェブサイトを使用するためメンバー登録する際、お客様はパスワードの設定を求められます。お客様はこのパスワードを機密に保管し、誰にも開示又は共有してはなりません。
3.2 お客様のパスワードの使用についてお客様は全面的に責任を負い、従ってこのパスワードの下になされた注文は、例えお客様が知らないものであっても全責任を負います。
3.3 お客様のパスワードを他の誰かが知っている、又は使用したことが分かった場合、又はその疑いがある場合は、即座にネスプレッソに通知してください。
4. 注文
4.1 本ウェブサイトから注文することにより、お客様は一般販売条件に基づきお客様の選んだ商品の購入を申し込んだものとします。
4.2 本ウェブサイトでのネスプレッソへの注文は、カプセルコーヒーの販売は1本(10カプセル入り)単位から注文を承ります。
4.3 本ウェブサイトでネスプレッソが提供する商品は販売可能な在庫数に限定されます。
5. 注文の上限
5.1 1つのアカウントにつき、1か月間に注文できるカプセルコーヒーの数は、通算1500カプセル(150本)までとします。
5.2 お客様のご注文が、前項の上限を超えた場合、当該注文全体を受け付けません。
6. 注文確認
6.1 本ウェブサイト上でお客様がした注文は、ネスプレッソがEメールにて確認通知を送信しない限り、拘束力を持つ契約とはみなされません。
6.2 ネスプレッソは、与信や未払い請求額などに関連して、注文を拒否する裁量権を留保します。
6.3 ネスプレッソにより登録されたデータは、注文内容及び取引全体の完全な証明とみなされます。支払いシステムにより登録されたデータは、当該金銭取引内容の完全な証明とみなされます。
7. 価格
7.1 お客様が注文した品目に対して支払われるべき価格は、お客様が注文をする日に本ウェブサイト上に表示される価格であり、その価格は商品毎に税込価格で表示されています。(但し、ショッピングバッグ内および注文プロセスにおいて、商品単価は税抜、配送料等は別表示となります。)
7.2 配送料は全国一律税込620円です。但し、本ウェブサイトでお支払金額が税込4,000円以上の場合、配送料(税込620円)は弊社が負担いたします。
7.3 ネスプレッソは随時商品価格及び配送料を変更する権利を留保し、書き間違い、印刷ミス又は計算の誤りがある場合に契約をキャンセルする権利を留保します。
8. 配達
8.1 ネスプレッソが確認した全ての注文は、お客様が注文する時に指定した配送先住所に配送します。
8.2 ネスプレッソは原則、午後5時迄のご注文は当日発送いたします。
8.3 発送は本ウェブサイト上に指定された国に限ります。
9. 返品
9.1 お客様のご都合によるカプセルコーヒー、チョコレート、シュガーなどの食品の取替え・返品はできません。コーヒーメーカー、アクセサリーなど食品以外の商品は、商品到着後8日以内にネスプレッソに連絡してください。商品到着後8日を経過した場合の返品はできません。
9.2 商品が配達時の状態、包装(化粧箱未開封)で、送り状とともに返送された場合に限り、ネスプレッソは返品を受理します。なお、商品を返品する際の郵送料はお客様の負担となります。
10. 支払い
10.1 ご利用いただけるお支払い方法は原則「クレジットカード」、「代金引換」または「ネスプレッソ ギフトカード」のみです。
10.2 クレジットカードによる支払いは直ちに支払期限となります。お客様のクレジットカード情報はセキュリティのため暗号化されます。
10.3 代金引換の場合、購入した商品を配送業者がお客様へお届けする際に、商品代金をお支払いいただきます。
11. コーヒーメーカーの保証
11.1 本ウェブサイトで購入されたコーヒーメーカーはお買い上げいただいた製品同梱書類に記載されている特定の条件の下でのネスプレッソによる保証付です。
11.2 メーカー保証に関する詳細内容については、お客様がお買い上げいただいた製品に同梱されている取扱説明書並びに保証書をご覧ください。ネスプレッソによる保証の内容はお客様の基本的な法定の権利を損なうものではありません。
12. アフターセールスのサービス
12.1コーヒーメーカーの機能、メンテナンス又はアフターセールスについて問題、質問が生じた場合、ネスプレッソに連絡の上、アドバイスあるいはアシスタンスを受けてください。
12.2 コーヒーメーカーの修理等、必要な場合、ネスプレッソは多様なアフターセールスのサービスオプションを提案いたします。詳細な情報については電話でネスプレッソに連絡してください。
13. 責任の制限
13.1 ウェブサイト上で商品を説明している写真、テキストなどは契約的なものではなく、情報の提供のみを目的としています。本ウェブサイト上で表示されている写真、テキストなどに誤りや遺漏がある場合、ネスプレッソは責任を負いません。
13.2 ネスプレッソによる商品出荷地以外の国々への海外配達品について、商品が配達先の国の法規に準拠しない場合、あるいは電圧の違い、その他商品の不適合の場合、ネスプレッソは責任を負いません。
13.3 ネスプレッソに故意又は重大な過失がある場合を除き、如何なる種類のクレームも、クレームが配達商品あるいは不配達商品、その他に関するものであるか否かによらず、請求金額が当該商品の購入価格を越えることはできません。商品、商品の使用、販売又はこのウェブサイトに関連して起こりうる間接損害、付随損害、あるいは結果損害(このような損害が発生することが例えネスプレッソに知られていたか、あるいは知ることが可能であったとしても)についてネスプレッソは一切責任を負いません。
14. 不可抗力
14.1 ネスプレッソはその義務を履行するための合理的なあらゆる努力をしなければなりません。但し、ネスプレッソは合理的なコントロールを超える状況によって引き起こされる履行の遅延又は不能については責任を負いません。このような状況には、ストライキ、戦争、自然災害その他商品の生産、輸送、配達を実際上不可能にするその他の状況を含みます。
14.2 履行遅延の場合、ネスプレッソはできる限り速やかに義務を履行しなければならず、また残存する商品供給量を顧客の間で公平かつ合理的に分配する権利を留保します。
15. 適用法及び裁判所
15.1 販売に関するこの一般条件は、お客様の注文に対して商品をお届けするネスプレッソ法人が設立されている国の法律に準拠します。
15.2 専属管轄権を持つ裁判所は適用法の国の裁判所とします。
