Conditions of Sale

Are subject to these terms and conditions all orders placed by individuals with Nespresso France (SAS with a capital of € 1,360,000 - RCS Paris B No. 382597821 ) , in-store or remotely ( mail, phone , fax, internet) , on the Nespresso machines Classic range as well as supplies and accessories dedicated to this range ( all hereinafter " Products "). An individual is a natural person who uses products for personal needs and those of his family.


1. Controls
1.1 The Products are offered for sale within the limits of available stocks.
1.2 The minimum quantity per order coffee shop is attached to a box of 10 capsules.
1.3 Nespresso retains ownership of the Products delivered until full payment of bills and reserves the right to suspend delivery in the event of late payment and this up regulation of total accounts receivable.
1.4 Nespresso reserves the right to refuse an order or require payment in advance, in case backlog invoice or insolvency.
2 . Right of return ( withdrawal)
2.1 Whatever the distribution channel used , you have a period of 14 days from receipt of product to notify us of your wish to return if we do not suit you, then 14 days from this notification to return it , without giving any reason .
2.2 For reasons of hygiene and safety , only be resumed products not used properly protected in their original packaging intact , in perfect condition, suitable for resale , with all possible accessories, manuals and documentation and the corresponding invoice. These conditions are cumulative.
2.3 Subject to the foregoing, Nespresso will refund by bank transfer prices returned products and shipping charged ( based on standard shipping costs ) if they have already been paid , within 14 days of the date you exercise your right of return. The return postage will be at your expense.
3 . Prices, invoicing and payment
3.1 For information about prices products, their characteristics and the shipping , please contact Nespresso boutiques , ask us by mail, by telephone or via the Nespresso website numbers and addresses listed in Section B.2 below.
3.2 Prices charged included, except delivery charges, corresponding to products you order all taxes are those in effect at the date of purchase when it takes place in the shop , or transmission of the order in case of sale distance . Invoices are payable .
3.3 In case of non- payment of amounts due to their due date , a conventional delay compensation of 10% of amount due will be required with a minimum of € 15 per claim. This allowance may not exceed the sum of € 40 regardless of the total amount outstanding.
4. Shipping
Delivery fees in France are those in effect at the date of transmission of the order as they appear on the rates applicable at that date. Unless otherwise indicated, they are at your expense and included separately in the invoice. Capsules on the package shipping is valid for a maximum shipping by sending 500 capsules. In addition , Nespresso will send you a quote. In case of delivery outside France, you are responsible , as an importer, the payment of all customs duties , taxes or other charges imposed upon arrival of the goods.
Methods of delivery 5.
Nespresso strives to ensure deliveries in France within 2 working days of receipt of the order to the address of your choice or one of the relay points available during the opening hours of the selected merchant. Nespresso offers the possibility of fast delivery in 24h ( working days ) by special shipping or courier on certain areas in France and some slots, for an extra charge . You may be asked for proof of your identity . If you ask different from that normally used by Nespresso shipping method , the extra cost you will be charged. Risk of loss and damage of products passes to you upon delivery.
6 . Checking Products
It is your responsibility to check the number and condition of products upon receipt and, in case of damaged or missing, do the usual caveats with the carrier and inform Nespresso within 7 days of reception (keeping the invoice and delivery note signed) . Nespresso will then issue identical replacement products or refund you.
Maintenance and after-sales service 7 .
Routine maintenance of the machine and cleaning your responsibility. Given the technical characteristics of the machines and for safety reasons , repairs should only be carried out by the manufacturer after-sales service according to the conditions of each machine. Accordingly , the manufacturer and Nespresso will be released from any liability in case of modification , repair, addition and / or replacement of parts on the machine by any other party than the after-sales service .
The availability of spare parts intended for repairable machine is 5 years from date of manufacture (information stated on the nameplate ) .
8. Guarantee machines
The machines are guaranteed by the manufacturer under the conditions transmitted when buying , but without prejudice to the legal guarantee against hidden defects as provided by Articles 1641 to 1649 of the Civil Code, which provides in part that " The seller must guarantee due to latent defects of the thing sold which render it unfit for the use for which it was intended , or that decrease this use that the buyer would not have acquired , or would have paid less defects if he had known "and the legal guarantee of conformity provided for in Articles L. 211-4 , L. 211-5 and L. 211-12 of the Consumer Code , notably that " The seller must deliver goods in conformity with the contract and liable for defects of conformity existing at the time of delivery. To comply with the contract, the goods must be suitable for the purpose usually associated with such a product . The action resulting from lack of conformity within two years after delivery of the goods . "
9. Guarantee data protection
9.1 Nespresso not transfer your personal data or to make them available to third parties in any form whatsoever except companies of the Nestlé Group, its subcontractors and its suppliers satisfaction surveys use them in a timely and confidential. These data are processed by Nespresso in strict compliance with applicable laws and its policy of protection of personal data as published on site.

10. Evolution of Terms
Nespresso reserves the right to modify at any time these terms and conditions by posting a new version that will apply to any order passed after it was first put online on site.
11. Applicable law and jurisdiction
Any dispute relating to the execution of a command and / or interpretation of these terms and conditions is subject to French law. In case of dispute concerning the interpretation or implementation of agreed between you and Nespresso agreements, an amicable solution will be sought before any legal action . Prior finding an amicable solution does not interrupt the time to act as collateral. Failing agreement, the competent Court shall , at the option of the applicant and in accordance with legal provisions , namely the place where the defendant lives or that of the place of actual delivery of the Product or of the place of execution of the service.

3 minimum quantity
The minimum order quantity of coffee sales is set at 5 cases , or 50 capsules.
4. Shipping
Costs and delivery terms are specified in Articles 4 and 5 above . However, shipping is free for orders placed by equal or greater Internet 200 capsules (excluding delivery service by appointment ) .
